9. UTILITIES <br /> A. Special charges for connection to sewer system in accordance <br /> with Ordinance 984-83 are applicable. The actual cost shall be <br /> computed by the Building Department per the ordinance in effect <br /> at the time of permit issuance and according to the information <br /> provided on the approved plans on the date of permit issuance. <br /> B. All utilities serving the subject property shall be installed <br /> underground. <br /> C. On-site detention shall be provided, or in lieu of providing <br /> on-site detention, payment to City Drainage Fund 340 shall be <br /> allowed. <br /> D. The installation of utilities within the sixty (60) foot wide <br /> portion of the property owned by Henry Liebman, which is <br /> located north of the two residentially zoned lots, if <br /> necessary, shall be underground and upon completion of the <br /> installation of such utilities, the ground surface shall be <br /> restored to the condition it was in prior to excavation. <br /> Access to the residential lots shall be maintained at all times <br /> during the installation of utilities. <br /> 10. BUILDING DESIGN <br /> A. Structures built on the subject property shall not exceed one <br /> story in height nor be greater than fifteen (15) feet above the <br /> ground elevation of adjacent residentially zoned properties at <br /> the property lines of said residential properties. <br /> B. All roof top mechanical equipment shall be architecturally <br /> screened so as not to be visible from surrounding properties. <br /> 11. NOISE <br /> All utility and mechanical equipment located on the subject <br /> property which produces noise during its normal course of <br /> operation shall be located away from adjacent residential I <br /> property boundaries so as to prevent nuisance noise. <br /> 12. AESTHETICS <br /> All trash containers located on the subject property shall be <br /> kept within solid enclosures constructed of wood, masonry or a <br /> combination of both in order to effectively screen the <br /> containers from the view of the general public and surrounding <br /> properties. <br /> Ii CONCOMITANT AGREEMENT - 7 <br />
