• <br /> WHEREAS, the Owners have agreed to develop the aforementioned <br /> property per the 19th Avenue S.E. Comprehensive Plan (The Plan), which is <br /> incorporated herein by reference in consideration of the City considering <br /> designating the property C-2 and the Owners further agree as part of said <br /> consideration that should the City zone the property C-2, to lay out, <br /> develop, and maintain the property as hereinafter set forth; <br /> NOW THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. PERMITTED USES <br /> A. The subject property shall be zoned C-2 Heavy Commercial Light <br /> Industrial Zone. <br /> B. Prohibited C-2 uses shall include: <br /> New and used car lots <br /> Auto wrecking yards <br /> Grain elevators <br /> Junk yards <br /> C. All parcels shall have outdoor storage allowed when such <br /> storage is enclosed by a minimum eight foot high <br /> sight-obscuring structure and landscaping, and when the <br /> interior of the storage area cannot be viewed by a pedestrian <br /> from any public right-of-way or adjacent property. A detailed <br /> screening plan for the outdoor storage area shall be reviewed <br /> and approved by the City Planning Department during the site <br /> plan review process. <br /> CONCOMITANT AGREEMENT - 2 <br />
