• <br /> 1 ORDINANCE NO. /a ? <br /> 2 <br /> AN ORDINANCE establishing a municipal court system for the City of <br /> 3 Everett pursuant to the Court Improvement Act of 1984; which has <br /> exclusive original jurisdiction over all violations of City ordinances <br /> 4 and such other cases as may be prescribed by State law. <br /> 5 <br /> 6 WHEREAS, the Washington State Legislature has enacted the Court <br /> 7 Improvement Act of 1984, RCW 3.50, effective July 1, 1984, authorizing cities with a <br /> 8 population of four hundred thousand or less to establish a municipal court; and <br /> 9 WHEREAS, the City of Everett finds that the establishment of a municipal court <br /> 10 is in the interests of the public health, safety and welfare; <br /> 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 12 Section 1: COURT ESTABLISHED. There is hereby established a municipal <br /> 13 court entitled "The Municipal Court of Everett," hereinafter referred to as "municipal <br /> 14 court," which court shall have jurisdiction and shall exercise all powers enumerated <br /> 15 herein and in RCW Chapter 3.50 together with such other powers and jurisdiction as are <br /> 16 generally conferred upon such court in this State either by common law or by express <br /> 17 statute. <br /> 18 Section 2: JURISDICTION. The municipal court shall have exclusive <br /> 19 original jurisdiction over traffic infractions arising under City ordinances and exclusive <br /> 20 original criminal jurisdiction of all violations of City of Everett ordinances. The <br /> 21 municipal court shall have original jurisdiction of all other actions brought to enforce or <br /> 22 recover penalties or forfeitures declared or given by such ordinances or by State <br /> 23 statutes. The municipal court shall also have the jurisdiction as conferred by statute. <br /> 24 The municipal court is empowered to forfeit cash bail or bail bonds and issue execution <br /> 25 thereon; and in general to hear and determine all causes, civil or criminal, including <br /> 26 traffic infractions, arising under such ordinances and to pronounce judgment in <br /> 27 accordance therewith. <br /> 28 Section 3: JUDGES-APPOINTMENT-QUALIFICATIONS. <br /> 29 A. The municipal judge shall be appointed by the Mayor within 30 days after <br /> 30 the effective date of this ordinance for a term of four (4) years which term pursuant to <br /> 31 RCW 3.50.040 shall have commenced on January 1, 1986.
