• <br /> 1 provided herein. The judge pro tern shall be compensated at the rate of $200 per day or <br /> 2 appropriate portions thereof as determined by the municipal judge. The term of the <br /> 3 appointment shall be specified in writing but in any event shall not extend beyond the <br /> 4 term of the appointing Mayor or judge. <br /> 5 Section 7: ADDITIONAL JUDGE-APPOINTMENT-QUALIFICATIONS-SALARY. <br /> 6 A. An additional judge shall be appointed by the Mayor within 30 days after <br /> 7 the effective date of this ordinance, subject to confirmation by the City Council, as <br /> 8 provided in Section 3 A above, for a term of four (4) years which term pursuant to RCW <br /> 9 3.50.040 shall have commenced on January 1, 1986. Appointments for each term <br /> 10 thereafter shall be made on or before December 1st of the year next preceding <br /> 11 January 1st of the year in which the next term commences. <br /> 12 B. A person appointed as additional municipal judge shall be a citizen of the <br /> 13 United States of America and of the State of Washington; and an attorney admitted to <br /> 14 practice law before the courts of record of the State of Washington. <br /> 15 C. The additional judge shall serve on a part-time basis of less than 90 hours <br /> 16 per month when the public interest and administration of justice make such judge <br /> 17 necessary. The salary of the additional judge shall be $900 per month. <br /> 18 Section 8: JUDICIAL VACANCY. Any vacancy in the municipal court due <br /> 19 to a death, disability, or resignation of a municipal court judge shall be filled by the <br /> 20 Mayor for the remainder of the unexpired term. The appointment shall be subject to <br /> 21 confirmation of the City Council, as provided in Section 3 A above. The appointed <br /> 22 judge shall be qualified to hold the position of judge of the municipal court as provided <br /> 23 in this chapter. <br /> 24 Section 9: MUNICIPAL COURT HOURS. The Everett Municipal Court shall <br /> 25 be open and shall hold such regular and special sessions as may be prescribed by the <br /> 26 judge; provided, that the municipal court shall not be open on nonjudicial days. <br /> 27 Section 10: SENTENCES. <br /> 28 A. In all cases of conviction, unless otherwise provided in Chapters 3.30 <br /> 29 through 3.74 RCW as now or hereafter amended, where a jail sentence is given to the <br /> 30 defendant, execution shall issue accordingly and where the judgment of the court is that <br /> 31 the defendant pay a fine and costs, the defendant may be committed to jail until the <br /> 32 judgment is paid in full. <br /> 3 <br />
