• <br /> ti <br /> 1 interpretations of this Code and to hear appeals from written <br /> orders issued by the City's Fire Marshal, the Board of Appeals <br /> 2 created pursuant to Ordinance No. 351-75 shall hear these <br /> matters. Appeals from written orders of the Fire Marshal must be <br /> 3 filed within thirty (30) calendar days from the date of receipt <br /> of the written order by the aggrieved party. The aggrieved party <br /> 4 shall cause to be made at his own expense any tests or research <br /> required to substantiate his claim. <br /> 5 <br /> 6 B. The 1985 Editions of the UFC and the UFCS are each amended by the <br /> 7 addition of the following language: <br /> 8 <br /> Any person, firm, or corporation violating any of the provisions <br /> 9 of the UFC or the UFCS, shall be deemed guilty of a misdemeanor, <br /> and each such person shall be deemed guilty of a separate offense <br /> 10 for each and every day or portion thereof during which any <br /> violation of any of the provisions of the UFC or UFCS is <br /> 11 committed, continued or permitted, and upon conviction of any <br /> such violation, such person shall be punishable by a fine or not <br /> 12 more than one thousand dollars ($1,000) or by imprisonment for <br /> not more than ninety (90) days or by both such fine and <br /> 13 imprisonment. <br /> 14 <br /> C. The 1985 Editions of the UFC and UFCS are each amended by the <br /> 15 <br /> addition of the following language: <br /> 16 <br /> 17 Authority to Abate <br /> 18 1. Any violation of the UFC or UFCS is hereby declared to be a <br /> nuisance. <br /> 19 <br /> 2. Where a nuisance exists, the City Attorney on behalf of the <br /> 20 City is authorized to instutute injunction, mandamus, or <br /> other appropriate action or proceeding to prevent the <br /> 21 violation of the UFC or UFCS. <br /> 22 3. Notwithstanding paragraph (2), the City Attorney is <br /> authorized to apply to any court of competent jurisdiction <br /> 23 for and such court, upon hearing and for cause shown, may <br /> grant a temporary or permanent injunction restraining any <br /> 24 person, firm and/or corporation from violating any <br /> provision of the UFC or UFCS. <br /> 25 <br /> 4. A conviction of any person, firm or corporation for <br /> 26 violating the UFC or UFCS shall not impede the authority <br /> granted in this section to the City Attorney or City. <br /> 27 <br /> 28 D. The 1985 Editions of the UFC and UFCS are each amended by the <br /> 29 addition of the following: <br /> 30 <br /> Fire Marshal Order <br /> 31 <br /> 1.
