• <br /> 1 ORDINANCE NO. .../4„.76-/-/-F , <br /> 2 <br /> AN ORDINANCE adopting the 1985 Edition of the Uniform Code for the <br /> 3 Abatement of Dangerous Buildings as amended herein and repealing <br /> Ordinance No. 725-80. <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1: There is hereby adopted by the City of Everett, that certain Code <br /> 7 <br /> known as the Uniform Code for the Abatement of Dangerous Buildings, the 1985 Edition <br /> 8 <br /> thereof and the whole thereof, save and except such portions as are hereinafter deleted, <br /> 9 <br /> modified or amended by this ordinance. <br /> 10 <br /> Section 2: Amendments Made In The Uniform Code For The Abatement Of <br /> 11 <br /> Dangerous Buildings. <br /> 12 <br /> A. Section 102(a) of the Uniform Code for the Abatement of Dangerous <br /> 13 <br /> Buildings is hereby amended by deleting: <br /> 14 <br /> 15 It is the purpose of this Code to provide a just, equitable and practicable <br /> method, to be cumulative with and in addition to, any other remedy <br /> 16 provided by the Building Code, Housing Code or otherwise available at <br /> law, whereby buildings or structures which from any cause endanger the <br /> 17 life, limb, health, morals, property, safety or welfare of the general <br /> public or their occupants may be required to be repaired, vacated or <br /> 18 demolished. <br /> 19 <br /> and inserting in its place: <br /> 20 <br /> 21 It is expressly the purpose of this Code to provide for and promote the <br /> health, safety and welfare of the general public, and not to create or <br /> 22 otherwise establish or designate any particular class or group of persons <br /> who will or should be especially protected or benefited by the terms of <br /> 23 this Code. <br /> 24 It is the specific intent of this Code to place the obligation of complying <br /> with its requirements upon any person owning, operating or controlling <br /> 25 any building or structure within its scope and no provision nor any term <br /> used in this Code is intended to impose any duty whatsoever upon the City <br /> 26 or any of its officers or employees, for whom the implementation or <br /> enforcement of this Code shall be discretionary and not mandatory. <br /> 27 <br /> Nothing contained in this code is intended to be nor shall be construed to <br /> 28 create or form the basis for any liability on the part of the City, or its <br /> officers, employees or agents, for any injury or damage resulting from the <br /> 29 failure of a building to comply with the provisions of this Code, or by <br /> reason or in consequence of any inspection, notice, order, certificate, <br /> 30 permission or approval authorized or issued or done in connection with the <br /> implementation or enforcement of this Code, or by reason of any action <br /> 31 or inaction on the part of the City related in any manner to the <br /> enforcement of this Code by its officers, employees or agents. <br /> 32 <br />
