• 1 ORDINANCE NO. .../4„.76-/-/-F , 2 AN ORDINANCE adopting the 1985 Edition of the Uniform Code for the 3 Abatement of Dangerous Buildings as amended herein and repealing Ordinance No. 725-80. 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1: There is hereby adopted by the City of Everett, that certain Code 7 known as the Uniform Code for the Abatement of Dangerous Buildings, the 1985 Edition 8 thereof and the whole thereof, save and except such portions as are hereinafter deleted, 9 modified or amended by this ordinance. 10 Section 2: Amendments Made In The Uniform Code For The Abatement Of 11 Dangerous Buildings. 12 A. Section 102(a) of the Uniform Code for the Abatement of Dangerous 13 Buildings is hereby amended by deleting: 14 15 It is the purpose of this Code to provide a just, equitable and practicable method, to be cumulative with and in addition to, any other remedy 16 provided by the Building Code, Housing Code or otherwise available at law, whereby buildings or structures which from any cause endanger the 17 life, limb, health, morals, property, safety or welfare of the general public or their occupants may be required to be repaired, vacated or 18 demolished. 19 and inserting in its place: 20 21 It is expressly the purpose of this Code to provide for and promote the health, safety and welfare of the general public, and not to create or 22 otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of 23 this Code. 24 It is the specific intent of this Code to place the obligation of complying with its requirements upon any person owning, operating or controlling 25 any building or structure within its scope and no provision nor any term used in this Code is intended to impose any duty whatsoever upon the City 26 or any of its officers or employees, for whom the implementation or enforcement of this Code shall be discretionary and not mandatory. 27 Nothing contained in this code is intended to be nor shall be construed to 28 create or form the basis for any liability on the part of the City, or its officers, employees or agents, for any injury or damage resulting from the 29 failure of a building to comply with the provisions of this Code, or by reason or in consequence of any inspection, notice, order, certificate, 30 permission or approval authorized or issued or done in connection with the implementation or enforcement of this Code, or by reason of any action 31 or inaction on the part of the City related in any manner to the enforcement of this Code by its officers, employees or agents. 32
