• 1 Notwithstanding any language used in this Code, it is not the intent of this Code to create a duty and/or cause of action running to any individual or 2 identifiable person but rather any duty is intended to run only to the general public. 3 4 B. Section 205 of the Uniform Code for the Abatement of Dangerous 5 Buildings, 1985 Edition, is hereby amended by deleting: 6 Sec. 205. In order to provide for reasonable interpretation of the 7 provisions of this code and to hear appeals provided for hereunder, there is hereby created a Board of Appeals consisting of five members who are 8 qualified by experience and training to pass upon matters pertaining to building construction and who are not employees of the jurisdiction. The 9 building official shall be an ex officio member of and shall act as secretary to said board. The Board of Appeals shall be appointed by the 10 governing body and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business and shall render all 11 decisions and findings in writing to the appellant, with a duplicate copy to the building official. Appeals to the board shall be processed in 12 accordance with the provisions contained in Section 501 of this code. Copies of all rules or regulations adopted by the board shall be delivered 13 to the building official, who shall make them freely accessible to the public. 14 15 and inserting in its place: 16 In order to determine the suitability of alternate materials and methods 17 of construction, to provide for reasonable interpretations of this Code and to hear appeals from written orders issued by the City's Building Official, 18 the Board of Appeals created pursuant to Ordinance No. 351-75 shall hear these matters. Appeals from written orders of the Building Official must 19 be filed within thirty (30) calendar days from the date of receipt of the written order by the aggrieved party. The aggrieved party shall cause to 20 be made at his own expense any tests or research required to substantiate his claim. 21 22 C. Section 302 of the Uniform Code for the Abatement of Dangerous 23 Buildings, 1985 Edition, is hereby amended by adding this additional section: 24 For the purposes of this Code, the power to order abatement by repairing, 25 rehabilitation, demolition or removal shall include the power to order a dangerous building which is vacant or for which an order of vacation is in 26 effect secured against unauthorized entry. 27 D.
