• <br /> 1 Notwithstanding any language used in this Code, it is not the intent of this <br /> Code to create a duty and/or cause of action running to any individual or <br /> 2 identifiable person but rather any duty is intended to run only to the <br /> general public. <br /> 3 <br /> 4 B. Section 205 of the Uniform Code for the Abatement of Dangerous <br /> 5 Buildings, 1985 Edition, is hereby amended by deleting: <br /> 6 <br /> Sec. 205. In order to provide for reasonable interpretation of the <br /> 7 provisions of this code and to hear appeals provided for hereunder, there <br /> is hereby created a Board of Appeals consisting of five members who are <br /> 8 qualified by experience and training to pass upon matters pertaining to <br /> building construction and who are not employees of the jurisdiction. The <br /> 9 building official shall be an ex officio member of and shall act as <br /> secretary to said board. The Board of Appeals shall be appointed by the <br /> 10 governing body and shall hold office at its pleasure. The board shall adopt <br /> rules of procedure for conducting its business and shall render all <br /> 11 decisions and findings in writing to the appellant, with a duplicate copy to <br /> the building official. Appeals to the board shall be processed in <br /> 12 accordance with the provisions contained in Section 501 of this code. <br /> Copies of all rules or regulations adopted by the board shall be delivered <br /> 13 to the building official, who shall make them freely accessible to the <br /> public. <br /> 14 <br /> 15 and inserting in its place: <br /> 16 <br /> In order to determine the suitability of alternate materials and methods <br /> 17 of construction, to provide for reasonable interpretations of this Code and <br /> to hear appeals from written orders issued by the City's Building Official, <br /> 18 the Board of Appeals created pursuant to Ordinance No. 351-75 shall hear <br /> these matters. Appeals from written orders of the Building Official must <br /> 19 be filed within thirty (30) calendar days from the date of receipt of the <br /> written order by the aggrieved party. The aggrieved party shall cause to <br /> 20 be made at his own expense any tests or research required to substantiate <br /> his claim. <br /> 21 <br /> 22 C. Section 302 of the Uniform Code for the Abatement of Dangerous <br /> 23 Buildings, 1985 Edition, is hereby amended by adding this additional section: <br /> 24 <br /> For the purposes of this Code, the power to order abatement by repairing, <br /> 25 rehabilitation, demolition or removal shall include the power to order a <br /> dangerous building which is vacant or for which an order of vacation is in <br /> 26 effect secured against unauthorized entry. <br /> 27 <br /> D.
