1 authorizing the Building Official to affect the immediate repair, securing, <br /> vacation or demolition of the dangerous building. The costs of the <br /> 2 emergency repair, securing, vacation, or demolition of such dangerous <br /> buildings shall be collected in the same manner as provided in Chapter <br /> 3 Nine. <br /> 4 <br /> I. Section 203 of the Uniform Code for the Abatement of Dangerous <br /> 5 <br /> Buildings, 1985 Edition, is hereby amended by the addition of the following: <br /> 6 <br /> 7 Any person, firm or corporation violating any provision of this code shall <br /> be deemed guilty of a misdemeanor and, upon conviction thereof, shall be <br /> 8 punishable by a fine not to exceed one thousand dollars ($1,000) or by <br /> imprisonment in jail not to exceed ninety (90) days, or both fine and <br /> 9 imprisonment. Each separate day or any portion thereof, during which <br /> any violation of this Code occurs or continues, shall be deemed to <br /> 10 constitute a separate offense and, upon conviction thereof, shall be <br /> punishable as herein provided. The issuance or granting of a permit or <br /> 11 approval of plans and specifications shall not be deemed or construed to <br /> be a permit for, or an approval of, any violation of any of the provisions <br /> 12 of this Code. No permit presuming to give authority to violate or cancel <br /> the provisions of this Code shall be valid, except insofar as the work or <br /> 13 use which it authorized is lawful. <br /> 14 <br /> J. The Uniform Code for the Abatement of Dangerous Buildings, 1985 <br /> 15 <br /> Edition, is hereby amended by the addition of the following section: <br /> 16 <br /> 17 Authority to Abate. <br /> 18 a) Any violation of the Code is hereby declared to be a nuisance. <br /> 19 b) Where a nuisance exists, the City Attorney on behalf of the City is <br /> authorized to institute injunction, mandamus, or other appropriate <br /> 20 action or proceeding to prevent the violation of this Code. <br /> 21 c) Notwithstanding paragraph (b), the City Attorney is authorized to <br /> apply to any court of competent jurisdiction for and such court, <br /> 22 upon hearing and for cause shown, may grant a temporary or <br /> permanent injunction restraining any person, firm and/or corpora- <br /> 23 tion from violating any provision of this Code and compelling <br /> compliance herewith. The cost of such action shall be taxed <br /> 24 against the violator. <br /> 25 d) A conviction of any person, firm or corporation for violating this <br /> Code shall not impede the authority granted in this section to the <br /> 26 City Attorney or City. <br /> 27 <br /> Section 3: Ordinance No. 725-80 and all other ordinances which are in <br /> 28 <br /> conflict herewith are hereby repealed. <br /> 29 <br /> Section 4: The City of Everett hereby declares that should any section, <br /> 30 <br /> paragraph, sentence or word of this ordinance or of the Uniform Code for the <br /> 31 <br /> 32 <br /> 5 <br />
