The costs of the 2 emergency repair, securing, vacation, or demolition of such dangerous buildings shall be collected in the same manner as provided in Chapter 3 Nine. 4 I. Section 203 of the Uniform Code for the Abatement of Dangerous 5 Buildings, 1985 Edition, is hereby amended by the addition of the following: 6 7 Any person, firm or corporation violating any provision of this code shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be 8 punishable by a fine not to exceed one thousand dollars ($1,000) or by imprisonment in jail not to exceed ninety (90) days, or both fine and 9 imprisonment. Each separate day or any portion thereof, during which any violation of this Code occurs or continues, shall be deemed to 10 constitute a separate offense and, upon conviction thereof, shall be punishable as herein provided. The issuance or granting of a permit or 11 approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions 12 of this Code. No permit presuming to give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or 13 use which it authorized is lawful. 14 J. The Uniform Code for the Abatement of Dangerous Buildings, 1985 15 Edition, is hereby amended by the addition of the following section: 16 17 Authority to Abate. 18 a) Any violation of the Code is hereby declared to be a nuisance. 19 b) Where a nuisance exists, the City Attorney on behalf of the City is authorized to institute injunction, mandamus, or other appropriate 20 action or proceeding to prevent the violation of this Code. 21 c) Notwithstanding paragraph (b), the City Attorney is authorized to apply to any court of competent jurisdiction for and such court, 22 upon hearing and for cause shown, may grant a temporary or permanent injunction restraining any person, firm and/or corpora- 23 tion from violating any provision of this Code and compelling compliance herewith. The cost of such action shall be taxed 24 against the violator. 25 d) A conviction of any person, firm or corporation for violating this Code shall not impede the authority granted in this section to the 26 City Attorney or City. 27 Section 3: Ordinance No. 725-80 and all other ordinances which are in 28 conflict herewith are hereby repealed. 29 Section 4: The City of Everett hereby declares that should any section, 30 paragraph, sentence or word of this ordinance or of the Uniform Code for the 31 32 5
