• - <br /> 1 The issuance or granting of a permit or approval of plans shall not prevent <br /> the Administrative Authority from thereafter requiring the correction of <br /> 2 errors in said plans and specifications or from preventing construction <br /> operations being carried on thereunder when in violation of this Code or <br /> 3 of any other ordinance or from revoking any certificate of approval when <br /> issued an error. <br /> 4 <br /> 5 Section 8: AUTHORITY TO ABATE. <br /> 6 A. Any violation of this ordinance, the codes or regulations <br /> 7 herein adopted is hereby declared to be a nuisance. <br /> 8 B. Where a nuisance exists, the City Attorney on behalf of the City is <br /> 9 authorized to institute injunction, mandamus, or other appropriate action or proceeding <br /> 10 to prevent the violation of this ordinance. <br /> 11 C. Notwithstanding paragraph B, the City Attorney is authorized to apply to <br /> 12 any court of competent jurisdiction for and such court, upon hearing and for cause <br /> 13 shown, may grant a temporary or permanent injunction restraining any person, firm <br /> 14 and/or corporation from violating any provision of this ordinance or the codes herein <br /> 15 adopted and compelling compliance herewith. The cost of such action shall be taxed <br /> 16 against the violator. <br /> 17 D. A conviction of any person, firm or corporation for violating <br /> 18 this ordinance, the codes or regulations herein adopted shall not impede <br /> 19 the authority granted in this section to the City Attorney or City. <br /> 20 Section 9: The City of Everett hereby declares that should any section, <br /> 21 paragraph, sentence or word of this ordinance, of the codes or regulations hereby <br /> 22 adopted be declared for any reason to be invalid, it is the intent of the City of Everett <br /> 23 that it would have passed all portions of this ordinance and the codes independent of the <br /> 24 elimination herefrom of any such portion as may be declared invalid. <br /> 25 Section 10: Ordinance No.'s 807-81, 724-80 and all other ordinances in conflict <br /> 26 herewith are hereby repealed. 1 <br /> 27 V <br /> MAYOR Io -"r& <br /> 28 ATTEST: <br /> I29 . <br /> 30 CITY CLERK <br /> 31 Passed: .5/'7--/6 <br /> Valid: <br /> 32 Published: --„2� <br /> 8 <br />
