1 or inaction on the part of the City related in any manner to the <br /> implementation or the enforcement of this Code by its officers, <br /> 2 employees or agents. <br /> 3 Notwithstanding any language in this Code, it is not the intent of this <br /> Code to create a duty and/or cause of action running to any individual or <br /> 4 identifiable person but rather any duty is intended to run only to the <br /> general public. <br /> 5 <br /> 6 Section 5: That WAC 296-46-230 as set forth in the Department of Labor and <br /> 7 Industries Rules and Regulations for installing electrical wires and equipment and <br /> 8 Administrative Rules as herein adopted is hereby amended by a new Section 4 which <br /> 9 shall read as follows: <br /> 10 <br /> All service conductors, meter bases, and service distribution panels must <br /> 11 have the same rating. Flexible metal conduit may be used, by approval of <br /> the Building Official, where the use of metallic conduit is impractical or <br /> 12 where flexibility of connections is essential. All flexible conduit exposed <br /> to the weather or corrosive atmosphere shall be sealed tight, except for <br /> 13 mobile home installations. Bx shall not be used. <br /> 14 <br /> Section 6: That Section WAC 296-46-150 of the Department of Labor and <br /> 15 <br /> Industries Rules and Regulations for installing electric wires and equipment and <br /> 16 <br /> administrative rules as herein adopted be and is hereby amended by adding the <br /> 17 <br /> following: <br /> 18 <br /> 19 Regardless of any other provisions in this chapter, all buildings, except for <br /> dwelling occupancy, shall be wired in only metallic raceways. <br /> 20 <br /> 21 Section 7: Each of the codes and regulations adopted by reference in <br /> 22 Section 2 of this ordinance is hereby amended by the addition of the following: <br /> 23 <br /> Violations and Penalties. <br /> 24 <br /> Any person, firm or corporation violating any provision herein shall be <br /> 25 deemed guilty of a misdemeanor and upon conviction thereof shall be <br /> punishable by a fine not to exceed $1,000 or by imprisonment not to <br /> 26 exceed 90 days or both fine and imprisonment. Each separate day or any <br /> portion thereof during which any violation of this Code occurs or <br /> 27 continues shall be deemed to constitute a separate offense, and upon <br /> conviction thereof shall be punishable as herein provided. The issuance or <br /> 28 granting of a permit or approval of plans and specifications shall not be <br /> deemed or construed to be a permit for, or an approval of, any violation <br /> 29 of any of the provisions of this Code. No permit presuming to give <br /> authority to violate or cancel the provisions of this Code shall be valid, <br /> 30 except insofar as the work or use which it authorized is lawful. <br /> 31 <br /> 32 <br /> 7 <br />
