9 . 1 ORDINANCE NO. 4,75",„?—f 2 AN ORDINANCE providing for the adoption of the 1985 Edition of the 3 Uniform Mechanical Code and repealing Ordinance No. 724-80. 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1: This ordinance shall be known as the "Everett Mechanical Code." 7 Section 2: The Uniform Mechanical Code, together with Appendices A, B and 8 C as published by the International Conference of Building Officials being particularly 9 the 1985 Editions thereof and the whole thereof, save and except such portions as are 10 hereinafter deleted, modified or amended are hereby adopted by reference and 11 incorporated herein as fully as if set out at length herein. 12 Section 3: Amendments Made In The Uniform Mechanical Code. 13 A. Section 203 of the 1985 Edition of the Uniform Mechanical Code is hereby 14 amended by deleting: 15 In order to determine the suitability of alternate materials and methods 16 of installation and to provide for reasonable interpretations of this Code, there shall be and is hereby created a Board of Appeals, consisting of 17 members who are qualified by experience and training to pass upon matters pertaining to mechanical design, construction and maintenance 18 and the public health aspects of mechanical systems. The building official shall be an ex officio member and shall act as secretary of the board. The 19 Board of Appeals shall be appointed by the governing body and shall hold office at its pleasure. The board shall adopt reasonable rules and 20 regulations for conducting its investigations and shall render all decisions and findings in writing to the building official with a duplicate copy to the 21 appellant. 22 and inserting in its place: 23 24 In order to determine the suitability of alternate materials and methods of installation, to provide for reasonable interpretations of this Code and 25 to hear appeals from written orders issued by the City's Building Official, the Board of Appeals created pursuant to Ordinance No. 351-75 shall hear 26 these matters. Appeals from written orders of the Building Official must be filed within thirty (30) calendar days from the date of receipt of the 27 written order by the aggrieved party. The aggrieved party shall cause to be made at his own expense any tests or research required to substantiate 28 his claim. 29 B. Section 204 of the 1985 Edition of the Uniform Mechanical Code is hereby 30 amended by the addition of the following: 31 32
