r , x 1 Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor and each such person shall 2 be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any the provisions of this Code is 3 committed, continued or permitted, and upon conviction of any such violation, such person shall be punishable by a fine of not more than 4 $1,000 or by imprisonment for not more than 90 days or both such fine and imprisonment. 5 6 C. Section 102 of the 1985 Edition of the Uniform Mechanical Code is hereby 7 amended by deleting: 8 Sec. 102. The purpose of this code is to provide minimum standards to 9 safeguard life or limb, health, property and public welfare by regulating and controlling the design, construction, installation, quality of materials, 10 location, operation, and maintenance or use of heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous 11 heat-producing appliances within this jurisdiction. 12 and inserting in its place: 13 14 It is expressly the purpose of this Code to provide for and promote the health, safety and welfare of the general public and not to create or 15 otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of 16 this Code. 17 It is the specific intent of these regulations to place the obligation of complying with these regulations upon the permit applicant and any 18 person owning, operating or controlling any building or structure within its scope. No provision nor term used in this Code is intended to impose any 19 duty whatsoever upon the City or any of its officers or employees for whom the implementation or enforcement of this Code shall be discre- 20 tionary and not mandatory. 21 Nothing in this Code is intended to be nor shall be construed to create or form the basis for any liability on the part of the City or its officers, 22 employees or agents, for any injury or damage resulting from the failure of a building to comply with the provisions of this Code, or by reason or in 23 consequence of any inspection, notice, order, certificate, permission or approval authorized or issued or done in connection with the implementa- 24 tion or enforcement of this Code, or by reason of any action of the City related in any manner to the enforcement of this Code by its officers, 25 employees or agents. 26 Notwithstanding any language used in this Code, it is not the intent of this Code to create a duty and/or cause of action running to any individual or 27 identifiable person but rather any duty is intended to run only to the general public. 28 29 D.
