r , x <br /> 1 Any person, firm or corporation violating any of the provisions of this <br /> Code shall be deemed guilty of a misdemeanor and each such person shall <br /> 2 be deemed guilty of a separate offense for each and every day or portion <br /> thereof during which any violation of any the provisions of this Code is <br /> 3 committed, continued or permitted, and upon conviction of any such <br /> violation, such person shall be punishable by a fine of not more than <br /> 4 $1,000 or by imprisonment for not more than 90 days or both such fine and <br /> imprisonment. <br /> 5 <br /> 6 C. Section 102 of the 1985 Edition of the Uniform Mechanical Code is hereby <br /> 7 amended by deleting: <br /> 8 <br /> Sec. 102. The purpose of this code is to provide minimum standards to <br /> 9 safeguard life or limb, health, property and public welfare by regulating <br /> and controlling the design, construction, installation, quality of materials, <br /> 10 location, operation, and maintenance or use of heating, ventilating, <br /> cooling, refrigeration systems, incinerators and other miscellaneous <br /> 11 heat-producing appliances within this jurisdiction. <br /> 12 <br /> and inserting in its place: <br /> 13 <br /> 14 It is expressly the purpose of this Code to provide for and promote the <br /> health, safety and welfare of the general public and not to create or <br /> 15 otherwise establish or designate any particular class or group of persons <br /> who will or should be especially protected or benefited by the terms of <br /> 16 this Code. <br /> 17 It is the specific intent of these regulations to place the obligation of <br /> complying with these regulations upon the permit applicant and any <br /> 18 person owning, operating or controlling any building or structure within its <br /> scope. No provision nor term used in this Code is intended to impose any <br /> 19 duty whatsoever upon the City or any of its officers or employees for <br /> whom the implementation or enforcement of this Code shall be discre- <br /> 20 tionary and not mandatory. <br /> 21 Nothing in this Code is intended to be nor shall be construed to create or <br /> form the basis for any liability on the part of the City or its officers, <br /> 22 employees or agents, for any injury or damage resulting from the failure <br /> of a building to comply with the provisions of this Code, or by reason or in <br /> 23 consequence of any inspection, notice, order, certificate, permission or <br /> approval authorized or issued or done in connection with the implementa- <br /> 24 tion or enforcement of this Code, or by reason of any action of the City <br /> related in any manner to the enforcement of this Code by its officers, <br /> 25 employees or agents. <br /> 26 Notwithstanding any language used in this Code, it is not the intent of this <br /> Code to create a duty and/or cause of action running to any individual or <br /> 27 identifiable person but rather any duty is intended to run only to the <br /> general public. <br /> 28 <br /> 29 D. The 1985 Edition of the Uniform Mechanical Code is hereby amended by <br /> 30 the addition of the following: <br /> 31 <br /> 32 <br /> 2 <br />
