• <br /> 1 Authorty to Abate. <br /> 2 a) Any violation of the Code is hereby declared to be a nuisance. <br /> 3 b) Where a nuisance exists, the City Attorney on behalf of the City is <br /> authorized to institute injunction, mandamus, or other appropriate <br /> 4 action or proceeding to prevent the violation of this Code. <br /> 5 c) Notwithstanding paragraph (b), the City Attorney is authorized to <br /> apply to any court of competent jurisdiction for and such court, <br /> 6 upon hearing and for cause shown, may grant a temporary or <br /> permanent injunction restraining any person, firm and/or corpora- <br /> 7 tion from violating any provision of this Code and compelling <br /> compliance herewith. The cost of such action shall be taxed <br /> 8 against the violator. <br /> 9 d) A conviction of any person, firm or corporation for violating this <br /> Code shall not impede the authority granted in this section to the <br /> 10 City Attorney or City. <br /> 11 <br /> Section 4: The City of Everett hereby declares that should any section, <br /> 12 <br /> paragraph, sentence or word of this ordinance or of the Uniform Mechanical Code <br /> 13 <br /> hereby adopted be declared for any reason to be invalid, it is the intent of the City of <br /> 14 <br /> Everett that it would have passed all portions of this ordinance and the Code <br /> 15 <br /> independent of the elimination herefrom of any such portion as may be declared invalid. <br /> 16 <br /> Section 5: Ordinance No. 724-80 and all other ordinances in conflict herewith <br /> 17 <br /> are hereby repealed. <br /> 18 / r <br /> 19 <br /> 20 WILLIAM E.
