• <br /> 1 Section 7: If any provision of this ordinance or its application to any person or <br /> 2 circumstance is held invalid, the remainder of the ordinance, or the application of the <br /> 3 provision to other persons or circumstances is not affected. <br /> 4 Section 8: It is expressly the purpose of this Code to provide for and promote <br /> 5 the health, safety and welfare of the general public, and not to create or otherwise <br /> 6 establish or designate any particular class or group of persons who will or should be <br /> 7 especially protected or benefited by the terms of this Code. <br /> 8 It is the specific intent of this Code to place the obligation of complying with <br /> 9 these regulations upon the permit applicant and any person owning or controllig any <br /> 10 building or structure within the scope of this Code and no provision nor term used in <br /> 11 this Code is intended to impose any duty whatsoever upon the City or any of its officers <br /> 12 or employees, for whom the implementation or enforcement of this Code shall be <br /> 13 discretionary and not mandatory. <br /> 14 Nothing contained in this Code is intended to be nor shall be construed to create <br /> 15 or form the basis for any liability on the part of the City, or its officers, employees or <br /> 16 agents, for any injury or damage resulting from the failure of a building to comply with <br /> 17 the provisions of this Code, or by reason or in consequence of any inspection, notice, <br /> 18 order, certificate, permission or approval authorized or issued or done in connection <br /> 19 with the implementation or enforcement of this Code, or by reason of any action or <br /> 20 inaction on the part of the City related in any manner to the enforcement of this Code <br /> 21 by its officers, employees or agents. <br /> 22 Notwithstanding any language in this Code, it is not the intent of this Code to <br /> 23 create a duty and/or cause of action running to any individual or identifiable person but <br /> 24 rather any duty is intended to run only to the general public. <br /> 25 Section 9: Repealer. <br /> 26 Ordinance No. 791-81 and all other ordinances in conflict herewith are hereby <br /> 27 repealed. <br /> 28 Section 10: Board of Appeals. <br /> 29 In order to determine the suitability of alternate materials and methods of <br /> 30 construction, to provide for reasonable interpretations of this Code and to hear appeals <br /> 31 from orders issued by the City's Building Official, the Board of Appeals created <br /> 32 <br /> 3 <br />
