I pursuant to Ordinance No. 351-75 shall hear these matters. Appeals from written <br /> 2 orders of the Building Official must be filed within thirty (30) calendar days from the <br /> 3 date of receipt of the written order by the aggrieved party. Such time limitation shall <br /> 4 not apply to oral orders or directions given by the Building Official. The aggrieved <br /> 5 party shall cause to be made at his own expense any tests or research required to <br /> 6 substantiate his claim. <br /> 7 Section 11: Authority to Abate. <br /> 8 A. Any violation of the Code or ordinance is hereby declared to be a <br /> 9 nuisance. <br /> 10 B. Where a nuisance exists, the City Attorney on behalf of the City is <br /> 11 authorized to institute injunction, mandamus, or other appropriate action or proceeding <br /> 12 to prevent the violation of this Code or ordinance. <br /> 13 C. Notwithstanding Paragraph B, the City Attorney is authorized to apply to <br /> 14 any court of competent jurisdiction for and such court, upon hearing and for cause <br /> 15 shown, may grant a temporary or permanent innunction restraining any person, firm <br /> 16 and/or corporation from violating any provision of this Code or ordinance and <br /> 17 compelling compliance herewith. The cost of such action shall be taxed against the <br /> 18 violator. <br /> 19 D. A conviction of any person, firm or corporation for violating this Code or <br /> 20 ordinance shall not impede the authority gran in this section to the City Attorney or <br /> 21 City. <br /> 22 <br /> 23 WIL LAE.
