• <br /> • <br /> 1 C. The State Energy Code is hereby amended by the addition of the <br /> 2 following: <br /> 3 <br /> It is expressly the purpose of this Code to provide for and promote the <br /> 4 health, safety and welfare of the general public, and not to create or <br /> otherwise establish or designate any particular class or group of persons <br /> 5 who will or should be especially protected or benefited by the terms of <br /> this Code. <br /> 6 <br /> It is the specific intent of this Code to place the obligation of complying <br /> 7 with its requirements upon the permit applicant and any person owning, <br /> operating or controlling any building or structure within its scope and no <br /> 8 provision nor term used in this Code is intended to impose any duty <br /> whatsoever upon the City or any of its officers or employees for whom <br /> 9 the implementation or enforcement of this Code shall be discretionary <br /> and not mandatory. <br /> 10 <br /> Nothing contained in this Code is intended to be nor shall be construed to <br /> 11 create or form the basis for any liability on the part of the City or its <br /> officers, employees or agents, for any injury or damage resulting from the <br /> 12 failure of a building to comply with the provisions of this Code, or by <br /> reason or inconsequence of any inspection, notice, order, certificate, <br /> 13 permission or approval authorized or issued or done in connection with the <br /> implementation or enforcement of this Code, or by reason of any action <br /> 14 of the City related in any manner to the enforcement of this Code by its <br /> officers, employees or agents. <br /> 15 <br /> Notwithstanding any language used in this Code, it is not the intent of this <br /> 16 Code to create a duty and/or cause of action running to any individual or <br /> identifiable person but rather any duty is intended to run only to the <br /> 17 general public. <br /> 18 <br /> D. The State Energy Code is hereby amended by the addition of the <br /> 19 <br /> following: <br /> 20 <br /> 21 Any person, firm or corporation violating any of the provisions of this <br /> 22 Code shall be deemed guilty of a misdemeanor and each such person shall <br /> be deemed guilty of a separate offense for each and every day or portion <br /> 23 thereof during which any violation of any the provisions of this Code is <br /> committed, continued or permitted, and upon conviction of any such <br /> 24 violation, such person shall be punishable by a fine of not more than <br /> $1,000 or by imprisonment for not more than 90 days or both such fine and <br /> 25 imprisonment. <br /> 26 Section 3: The City of Everett hereby declares that should any section, <br /> 27 paragraph, sentence or word of this ordinance or the State Energy Code hereby adopted <br /> 28 be declared for any reason to be invalid, it is the intent of the City of Everett that it <br /> 29 would have passed all portions of this ordinance and Code independent of the <br /> 30 elimination herefrom of any such portion as may be declared invalid. <br /> 31 <br /> 32 <br /> 2 <br />
