The State Energy Code is hereby amended by the addition of the 2 following: 3 It is expressly the purpose of this Code to provide for and promote the 4 health, safety and welfare of the general public, and not to create or otherwise establish or designate any particular class or group of persons 5 who will or should be especially protected or benefited by the terms of this Code. 6 It is the specific intent of this Code to place the obligation of complying 7 with its requirements upon the permit applicant and any person owning, operating or controlling any building or structure within its scope and no 8 provision nor term used in this Code is intended to impose any duty whatsoever upon the City or any of its officers or employees for whom 9 the implementation or enforcement of this Code shall be discretionary and not mandatory. 10 Nothing contained in this Code is intended to be nor shall be construed to 11 create or form the basis for any liability on the part of the City or its officers, employees or agents, for any injury or damage resulting from the 12 failure of a building to comply with the provisions of this Code, or by reason or inconsequence of any inspection, notice, order, certificate, 13 permission or approval authorized or issued or done in connection with the implementation or enforcement of this Code, or by reason of any action 14 of the City related in any manner to the enforcement of this Code by its officers, employees or agents. 15 Notwithstanding any language used in this Code, it is not the intent of this 16 Code to create a duty and/or cause of action running to any individual or identifiable person but rather any duty is intended to run only to the 17 general public. 18 D. The State Energy Code is hereby amended by the addition of the 19 following: 20 21 Any person, firm or corporation violating any of the provisions of this 22 Code shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion 23 thereof during which any violation of any the provisions of this Code is committed, continued or permitted, and upon conviction of any such 24 violation, such person shall be punishable by a fine of not more than $1,000 or by imprisonment for not more than 90 days or both such fine and 25 imprisonment. 26 Section 3: The City of Everett hereby declares that should any section, 27 paragraph, sentence or word of this ordinance or the State Energy Code hereby adopted 28 be declared for any reason to be invalid, it is the intent of the City of Everett that it 29 would have passed all portions of this ordinance and Code independent of the 30 elimination herefrom of any such portion as may be declared invalid. 31 32 2
