The 1985 Edition of the Uniform Plumbing Code, Section 20.3, and the 2 1985 Edition of the Uniform Plumbing Code Standards are hereby amended by the 3 addition of the following: 4 20.3 Any person, firm or corporation violating any provision of this 5 Code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed $1,000 or by 6 imprisonment not to exceed 90 days, or both fine and imprisonment. Each separate day or any portion thereof during which any violation of this 7 Code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein 8 provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an 9 approval of, any violation of any of the provisions of this Code. No permit presuming to give authority to violate or cancel the provisions of 10 this Code shall be valid, except insofar as the work or use which it authorized is lawful. 11 The issuance or granting of a permit or approval of plans shall not prevent 12 the Administrative Authority from thereafter requiring the correction of errors in said plans and specifications or from preventing construction 13 operations being carried on thereunder when in violation of this Code or of any other ordinance or from revoking any certificate of approval when 14 issued in error. 15 Every permit issued by the Administrative Authority under the provisions of this Code shall expire by limitation and become null and void, if the 16 work authorized by such permit is not commenced within one-hundred eighty (180) days from date of issuance of such permit, or if the work 17 authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of one-hundred twenty (120) days. 18 Before such work can be recommenced, a new permit shall be first obtained, and the fee shall be one-half the amount required for a new 19 permit for such work, provided no changes have been made, or will be made in the original plans and specifications for such work; and provided, 20 further, that such suspension or abandonment has not exceed one (1) year. 21 E. The 1985 Edition of the Uniform Plumbing Code, Title 20, and the 1985 22 Edition of the Uniform Plumbing Code Standards are hereby amended by the addition of 23 the following: 24 25 Authority to Abate 26 a. Any violation of the Code is hereby declared to be a nuisance. 27 b. Where a nuisance exists, the City Attorney on behalf of the City is authorized to institute injunction, mandamus, or other appropriate 28 action or proceeding to prevent the violation of this Code. 29 c. Notwithstanding paragraph (b), the City Attorney is authorized to apply to any court of competent jurisdiction for and such court, 30 upon hearing and for cause shown, may grant a temporary or permanent injunction restraining any person, firm and/or corpora- 31 tion from violating any provision of this Code and compelling compliance herewith. The cost of such action shall be taxed 32 against the violator. 2
