1 K. Section 10.2 of the 1985 Edition of the Uniform Plumbing Code is hereby <br /> 2 amended by deleting: <br /> 3 <br /> Purpose: 10.2. This Code is an ordinance providing minimum require- <br /> 4 ments and standards for the protection of public health, safety and <br /> welfare. <br /> 5 <br /> 6 and inserting in its place: <br /> 7 <br /> Purpose: 10.2. It is expressly the purpose of this Code to provide for <br /> 8 and promote the health, safety and welfare of the general public and not <br /> to create or otherwise establish or designate any particular class or group <br /> 9 of persons who will or should be especially protected or benefited by the <br /> terms of this Code. <br /> 10 <br /> It is the specific intent of these regulations to place the obligation of <br /> 11 complying with these regulations upon the permit applicant and any <br /> person owning, operating or controlling any building or structure within its <br /> 12 scope. No provision nor term used in this Code is intended to impose any <br /> duty whatsoever upon the City or any of its officers or employees, for <br /> 13 whom the implementation or enforcement of this Code shall be discre- <br /> tionary and not mandatory. <br /> 14 <br /> Nothing contained in this Code is intended to be nor shall be construed to <br /> 15 create or form the basis for any liability on the part of the City or its <br /> officers, employees or agents, for any injury or damage resulting from the <br /> 16 failure of a buliding to comply with the provisions of this Code or by <br /> person or inconsequence of any inspection, notice, order, certificate, <br /> 17 permission or approval authorized or issued or done in connection with the <br /> implementation or enforcement of this Code, or by reason of any action <br /> 18 of the City related in any manner to the enforcement of this Code by its <br /> officers, employees or agents. <br /> 19 <br /> Notwithstanding any language used in this Code, it is not the intent of this <br /> 20 Code to create a duty and/or cause of action running to any individual or <br /> identifiable person, but rather any duty is intended to run only to the <br /> 21 general public. <br /> 22 <br /> L.
