1 K. Section 10.2 of the 1985 Edition of the Uniform Plumbing Code is hereby 2 amended by deleting: 3 Purpose: 10.2. This Code is an ordinance providing minimum require- 4 ments and standards for the protection of public health, safety and welfare. 5 6 and inserting in its place: 7 Purpose: 10.2. It is expressly the purpose of this Code to provide for 8 and promote the health, safety and welfare of the general public and not to create or otherwise establish or designate any particular class or group 9 of persons who will or should be especially protected or benefited by the terms of this Code. 10 It is the specific intent of these regulations to place the obligation of 11 complying with these regulations upon the permit applicant and any person owning, operating or controlling any building or structure within its 12 scope. No provision nor term used in this Code is intended to impose any duty whatsoever upon the City or any of its officers or employees, for 13 whom the implementation or enforcement of this Code shall be discre- tionary and not mandatory. 14 Nothing contained in this Code is intended to be nor shall be construed to 15 create or form the basis for any liability on the part of the City or its officers, employees or agents, for any injury or damage resulting from the 16 failure of a buliding to comply with the provisions of this Code or by person or inconsequence of any inspection, notice, order, certificate, 17 permission or approval authorized or issued or done in connection with the implementation or enforcement of this Code, or by reason of any action 18 of the City related in any manner to the enforcement of this Code by its officers, employees or agents. 19 Notwithstanding any language used in this Code, it is not the intent of this 20 Code to create a duty and/or cause of action running to any individual or identifiable person, but rather any duty is intended to run only to the 21 general public. 22 L.
