• <br /> 1 J. Section 102 of the 1985 Edition of the UBC and the 1985 Edition of the <br /> 2 UBCS are hereby amended by the addition of the following language: <br /> 3 <br /> It is expressly the purpose of this Code to provide for and promote the <br /> 4 health, safety and welfare of the general public, and not to create or <br /> otherwise establish or designate any particular class or group of persons <br /> 5 who will or should be especially protected or benefited by the terms of <br /> this Code. <br /> 6 <br /> It is the specific intent of these regulations to place the obligation of <br /> 7 complying with these regulations upon the permit applicant and any <br /> person owning, operating or controlling any building or structure within its <br /> 8 scope and no provision nor term used in this Code is intended to impose <br /> any duty whatsoever upon the City or any of its officers or employees for <br /> 9 whom the implementation or enforcement of this Code shall be discre- <br /> tionary and not mandatory. <br /> 10 <br /> Nothing contained in this Code is intended to be nor shall be construed to <br /> 11 create or form the basis for any liability on the part of the City or its <br /> officers, employees or agents, for any injury or damage resulting from the <br /> 12 failure of a building to comply with the provisions of this Code, or be <br /> reason or inconsequence of any inspection, notice, order, certificate, <br /> 13 permission or approval authorized or issued or done in connection with the <br /> implementation or enforcement of this Code, or by reason of any action <br /> 14 of the City related in any manner to the enforcement of this Code by its <br /> officers, employees or agents. <br /> 15 <br /> Notwithstanding any language used in this Code, it is not the intent of this <br /> 16 Code to create a duty and/or cause of action running to any individual or <br /> identifiable person but rather any duty is intended to run only to the <br /> 17 general public. <br /> 18 <br /> Section 5: The City of Everett hereby declares that should any section, <br /> 19 <br /> paragraph, sentence or word of this ordinance or of the UBC or UBCS hereby adopted <br /> 20 <br /> be declared for any reason to be invalid, it is the intent of the City of Everett that it <br /> 21 <br /> would have passed all portions independent of the elimination herefrom of any such <br /> 22 <br /> portion as may be declared invalid. <br /> 23 <br /> Section 6: Ordinance No.'s 724-8 an 315-74 e hereby repealed. <br /> 24 A r � <br /> � tel/ <br /> 25 ( MAYOR26 <br /> CITY CLERK <br /> 27 Passed: 5---/%2--- <br /> 28 <br /> -/4-�28 Valid: <br /> 29 Published: .6-7.2/-Y' <br /> 30 <br /> 31 <br /> 32 <br /> 7 <br />
