• <br /> 1 ORDINANCE NO. ./A' - ' <br /> 2 <br /> AN ORDINANCE adopting the 1985 Edition of the Uniform Housing Code <br /> 3 and repealing Ordinance No. 726-80. <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1: The Uniform Housing Code, published by the International <br /> 7 Conference of Building Officials, being particularly the 1985 Edition thereof and the <br /> 8 whole thereof, save and except such portions as are hereinafter deleted, modified or <br /> 9 amended are hereby adopted by reference and incorporated herein as fully as if set out <br /> 10 at length herein. <br /> 11 Section 2: Amendments Made In The Uniform Housing Code. <br /> 12 A. Chapter 1, Section 102 of the Uniform Housing Code, 1985 Edition, which <br /> 13 reads as follows: <br /> 14 <br /> Sec. 102. The purpose of this code is to provide minimum standards to <br /> 15 safeguard life or limb, health, property and public welfare by regulating <br /> and controlling the use and occupancy, location and maintenance of all <br /> 16 residential buildings and structures within this jurisdiction. <br /> 17 <br /> be and the same is hereby amended to read as follows: <br /> 18 <br /> 19 It is expressly the purpose of this Code to provide for and promote the <br /> health, safety and welfare of the general public, and not to create or <br /> 20 otherwise establish or designate any particular class or group of persons <br /> who will or should be especially protected or benefited by the terms of <br /> 21 this Code. <br /> 22 It is the specific intent of this Code to place the obligation of complying <br /> with its requirements upon any person owning, operating or controlling <br /> 23 any building or structure within its scope, and no provision of nor term <br /> used in this Code is intended to impose any duty whatsoever upon the City <br /> 24 or any of its officers or employees, for whom the implementation or <br /> enforcement of this Code shall be discretionary and not mandatory. <br /> 25 <br /> Nothing contained in this Code is intended to be nor shall be construed to <br /> 26 create or form the basis for any liability on the part of the City, or its <br /> officers, employees or agents, for any injury or damage resulting from the <br /> 27 failure of a building to comply with the provisions of this Code, or by <br /> reason or in consequence of any inspection, notice, order, certificate, <br /> 28 permission or approval authorized or issued or done in connection with the <br /> implementation or enforcement of this Code, or by reason of any action <br /> 29 or inaction on the part of the City related in any manner to the <br /> enforcement of this Code by its officers, employees or agents. <br /> 30 <br /> 31 <br /> 32 <br />
