• <br /> 1 Notwithstanding any language used in this Code, it is not the intent of this <br /> Code to create a duty and/or cause of action running to any individual or <br /> 2 identifiable person but rather any duty is intended to run only to the <br /> general public. <br /> 3 <br /> 4 B. Chapter 3 of the Uniform Housing Code, 1985 Edition, is hereby amended <br /> 5 by adding a new section which reads as follows: <br /> 6 <br /> Inspection Fee <br /> 7 <br /> Section 304. Any person, firm, company, governmental unit or corpora- <br /> 8 tion requesting a Housing Code compliance inspection by the City of <br /> Everett shall pay a fee of twenty-five dollars ($25) per living unit to a <br /> 9 maximum of one thousand dollars ($1,000). <br /> 10 <br /> C. Section 204 of the Uniform Housing Code, 1985 Edition, is hereby <br /> 11 <br /> amended by adding: <br /> 12 <br /> 13 Any person, firm or corporation violating any provision of this Code shall <br /> be deemed guilty of a misdemeanor and, upon conviction thereof, shall be <br /> 14 punishable by a fine not to exceed one thousand dollars ($1,000) or by <br /> imprisonment in jail not to exceed ninety (90) days, or both fine and <br /> 15 imprisonment. Each separate day or any portion thereof, during which <br /> any violation of this Code occurs or continues, shall be deemed to <br /> 16 constitute a separate offense and, upon conviction thereof, shall be <br /> punishable as herein provided. The issuance or granting of a permit or <br /> 17 approval of plans and specifications shall not be deemed or construed to <br /> be a permit for, or an approval of, any violation of any of the provisions <br /> 18 of this Code. No permit presuming to give authority to violate or cancel <br /> the provisions of this Code shall be valid, except insofar as the work or <br /> 19 use which it authorized is lawful. <br /> 20 <br /> D. Chapter 2, Section 203 of the Uniform Housing Code is amended by <br /> 21 <br /> deleting: <br /> 22 <br /> 23 Sec. 203. In order to provide for final interpretation of the provisions <br /> of this Code and to hear appeals provided for hereunder, there is hereby <br /> 24 established a Housing Advisory and Appeals Board consisting of five <br /> members who are not employees of the City. The Building Official shall <br /> 25 be an ex-officio member of and shall act as secretary to said Board. The <br /> Board shall be appointed by the governing body and shall hold office at its <br /> 26 pleasure. The Board shall adopt reasonable rules and regulations for <br /> conducting its business and shall render all decisions and findings in <br /> 27 writing to the appellant with a copy to the Building Official. Appeals to <br /> the Board shall be processed in accordance with the provisions contained <br /> 28 in Section 1201 of this Code. Copies of all rules or regulations adopted by <br /> the Board shall be delivered to the Building Official, who shall make them <br /> 29 freely accessible to the public. <br /> 30 <br /> and inserting in its place: <br /> 31 <br /> 32 <br /> 2 <br />
