1 12.02.080 Backfire Flame Control. <br /> 2 When used on the waters of the City of Everett a motorboat or a <br /> motor vessel shall be equipped with the backfire flame control <br /> 3 devices as required by Title 46, Code of Federal Regulations, <br /> Subpart 25.35. <br /> 4 <br /> 5 12.02.090 Liquefied Petroleum Gas. <br /> 6 When a vessel is used to carry persons for hire on the waters of <br /> the City of Everett the use on such vessel of any liquefied <br /> 7 petroleum gas or certain flammable liquids for cooking, heating, <br /> or lighting is prohibited as required by Title 46, Code of <br /> 8 Federal Regulations, Subpart 25.45 and Parts 146 and 147. <br /> 9 12.02.100 Canadian Vessels. <br /> 10 When used on the waters of the City of Everett for a period less <br /> 11 than sixty days all Canadian vessels which comply with the <br /> boating safety laws of the government of Canada shall be exempt <br /> 12 from the provisions of EMC 12.02.020, 12.02.030, 12.02.040, <br /> 12.02.050, 12.02.070 , 12.02.080 and 12.02.090. <br /> 13 <br /> 14 12.02.110 Vessel Operators - Age Restriction. <br /> 15 It shall be unlawful for any motorboat to be operated, or for any <br /> person owning or in charge of any motorboat to authorize any <br /> 16 motorboat to be operated, by any person under the age of fourteen <br /> years unless such person is accompanied by a person who is over <br /> 17 the age of fourteen years. <br /> 18 <br /> 12.02.120 Negligent Operation of Vessel. <br /> 19 <br /> It shall be unlawful for any person to operate a vessel in a <br /> 20 negligent manner, except a commercial vessel which has or is <br /> required to have a valid marine document as a vessel of the <br /> 21 United States and is operating in the navigable waters of the <br /> United States. For the purpose of this section, to "operate in a <br /> 22 negligent manner" shall be construed to mean the operation of a <br /> vessel in such manner as to endanger or be likely to endanger any <br /> 23 persons or property. <br /> 24 A violation of this section is a misdemeanor, punishable by up to <br /> ninety days in jail and by a fine of not more than one thousand <br /> 25 dollars. In addition, the court may order the defendant to pay <br /> restitution for any damages or injuries resulting from the <br /> 26 offense. <br /> 27 <br /> 12.02.130 Operating a Vessel While Under the Influence of <br /> 28 Intoxicating Liquor or Any Drug. <br /> 29 A person is guilty of operating a vessel while under the <br /> influence of intoxicating liquor or any drug if the person <br /> 30 oeprates a vessel within this City while: <br /> 31 A. The person has 0.10 grams or more of alcohol per two <br /> hundred ten liters of breath, as shown by analysis of the <br /> 32 <br /> 4 <br />
