• person's breath, blood, or other bodily substance made under RCW 46.61.506; or 2 B. The person is under the influence of or affected by 3 intoxicating liquor or any drug; or 4 C. The person is under the combined influence of or affected by intoxicating liquor and any drug. 5 The fact that any person charged with a violation of this section 6 is or has been entitled to use such drug under the laws of this state shall not constitute a defense against any charge of 7 violating this section. A person cited under this subsection may upon request be given a breath test for blood alcohol or may 8 request to have a blood sample taken for blood alcohol analysis. An arresting officer shall administer field sobriety tests when 9 circumstances permit. 10 A violation of this section is a misdemeanor, punishable by up to ninety days in jail and by a fine of not more than one thousand 11 dollars. In addition, the court may order the defendant to pay restitution for any damages or injuries resulting from the 12 offense. 13 12.02.140 Obstructing Navigation--Penalty. 14 Every person who shall in any manner obstruct the navigable 15 portion or channel of the waters of the City of Everett, navigable and generally used for the navigation of vessels, 16 boats, or other watercrafts, or for the floating down of logs, cord wood, fencing posts or rails, shall be guilty of a 17 misdemeanor; provided, that the placing of any mill dam or boom across a stream used for floating saw logs, cord wood, fencing 18 posts or rails shall not be construed to be an obstruction to the navigation of such stream, if the same shall be so constructed as 19 to allow the passage of boats, saw logs, cord wood, fencing posts or rails without unreasonable delay. 20 21 12.02.150 Water Littering. 22 It shall be unlawful for any person to dump, throw or otherwise deposit junk, oil, trash, garbage, refuse, or other waste of any 23 kind, including sawdust, edgings, or refuse from any mill or manufacturing plant on or into the waters of the City of Everett. 24 25 12.02.160 Discharging Ballast. 26 Every master or mate, or other officer or other person, belonging to or in charge of any vessel, who shall discharge or cause to be 27 discharged the ballast of such vessels into the waters of the City of Everett shall be guilty of a misdemeanor. 28 29 12.02.170 Speed Limit - No Wake Zone. 30 There is hereby designated a "No Wake Zone" which shall consist of all the waters east of Jetty Island, north of latitude 31 47° 59' 00" and west of longitude 122° 13' 00" . 32 5
