1 ORDINANCE NO. <br /> 2 <br /> AN ORDINANCE relating to the municipal water supply system of <br /> 3 the City of Everett, providing rules and regulations for the <br /> operation and control of said system, regulating the supply and <br /> 4 use of water therefrom, providing a method of collecting charges <br /> therefor, providing a method of joining collection of other <br /> 5 utilities charges of the City, setting forth terms and conditions <br /> for the use thereof, providing for delinquent charges and <br /> 6 claiming a lien therefor, providing for certain special charges <br /> and penalties for violations and repealing all other ordinances <br /> 7 or parts of ordinances in conflict herewith. <br /> 8 <br /> 9 THE CITY OF EVERE ] DOES ORDAIN: <br /> 10 Section 1: Utilities Division--Acknowledgement. <br /> 11 The City Council acknowledges, ratifies and confirms the prior <br /> 12 establishment and existence of a subdivision within the Department of Public <br /> 13 Works which is known as the Utilities Division which shall include water <br /> 14 supply, sanitary sewage, and surface water drainage operations of the City. <br /> 15 Section 2: Utilities Division--Water Supply--Purpose. <br /> 16 The Utilities Division shall provide for the construction, operation <br /> 17 and maintenance of all necessary and desirable collection, diversion, <br /> 18 impoundment, transmission, treatment, storage and distribution facilities to <br /> 19 produce and convey a potable water supply to all inhabitants of the City and <br /> 20 such surrounding areas as the City Council may determine, for domestic, <br /> 21 commercial, industrial and manufacturing purposes. <br /> 22 Section 3: Definitions. <br /> 23 A. The term "Utilities Division" means that operational subdivision within <br /> the Department of Public Works of the City. Use of this term may refer <br /> 24 to the organization in general or apply to a particular functional unit <br /> or division thereof; <br /> 25 <br /> B. The term "water system" means the entire physical plant and facilities <br /> 26 operated or controlled by the Utilities Division, both within and <br /> outside the City limits which shall include but not be limited to all <br /> 27 lands, rights, easements, permits, impoundments, reservoirs, tunnels, <br /> treatment facilities, pipelines, trestles, bridges, roads, buildings, <br /> 28 structures, machines, equipment, records, pumps, valves, hydrants, <br /> meters, services and all related facilities and appurtenances for the <br /> 29 collection, treatment and delivery of water. The use of this term may <br /> refer to the entire water system or an appropriate functional division <br /> 30 or part thereof; <br /> 31 C. "Water service" means the entire process of supply development, <br /> impoundment, treatment, transmission, storage and distribution of water <br /> 32 <br />
