1 ORDINANCE NO. 4. 8 e\(p <br /> 2 <br /> AN ORDINANCE relating to dangerous dogs, adding a new chapter to <br /> 3 Title 6 (Animals) of the Everett Municipal Code and amending <br /> Ordinance No. 680-80, Chapter VI, Section 1 (E.M.C. 6.04.110). <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1: There shall be added a new chapter to Title 6 (Animals) of the <br /> 7 <br /> Everett Municipal Code, to be entitled "Dangerous Dogs." <br /> 8 <br /> Section 2: Definitions. As used in this chapter: <br /> 9 <br /> A. "Owner" means any person or legal entity having a possessory property <br /> 10 <br /> right in a dog or who harbors, cares for, exercises control over, or knowingly permits <br /> 11 <br /> any animal to remain on premises occupied by them. <br /> 12 <br /> B. "Dangerous dog" means: <br /> 13 <br /> 14 1. Any dog with a known propensity, tendency, or disposition to <br /> attack unprovoked, to cause injury to, or to otherwise endanger the <br /> 15 safety of humans or other domestic animals; or <br /> 16 2. Any dog which attacks a human being or other domestic animal <br /> without provocation. <br /> 17 <br /> 18 C. A dangerous dog is "unconfined" if such dog is not securely confined <br /> 19 indoors or confined in a securely enclosed and locked pen or structure upon the premises <br /> 20 of the owner of such dog. Such pen or structure must have secure sides and a secure <br /> 21 top. If the pen or structure has no bottom secured to the sides, the sides must be <br /> 22 embedded into the ground no less than one foot. <br /> 23 Section 3: Unconfined Dangerous Dog On Premises Of Owner. The owner of <br /> 24 a dangerous dog shall not suffer or permit such dog to go unconfined. <br /> 25 Section 4: Dangerous Dog Off Premises. The owner of a dangerous dog <br /> 26 shall not suffer or permit such dog to go beyond the premises of such person unless such <br /> 27 dog is securely leashed and muzzled or otherwise securely restrained and muzzled. <br /> 28 Section 5: Penalties. Any person, firm or corporation violating the pro- <br /> 29 visions of Section 3 or Section 4 of this ordinance shall be guilty of a gross misdemeanor <br /> 30 and may be punished by a fine of not more than five thousand dollars ($5,000) or <br /> 31 imprisonment of not more than one year in jail, or by both such fine and imprisonment. <br /> 32 <br />
