• <br /> • <br /> 1 Section 6: Chapter VI, Section 1 of Ordinance No. 680-80, which reads as <br /> 2 follows: <br /> 3 <br /> CHAPTER VI. PROHIBITED AND REGULATED CONDUCT <br /> 4 <br /> Section 1. Animal Owner Regulation <br /> 5 <br /> A. For purposes of this section, the term "permit" shall include human <br /> 6 conduct in relation to an owned or harbored animal which is <br /> intentional, deliberate, careless, inadvertent or negligent. <br /> 7 <br /> B. It shall be a violation of this ordinance for the owner of any animal <br /> 8 to: <br /> 9 1. Permit any animal to become at large. <br /> Exception: Domestic cats. <br /> 10 <br /> 2. Permit a domestic cat to trespass upon the property of <br /> 11 another in such a manner as to be a nuisance. <br /> 12 3. Permit an animal on public premises, property or <br /> right-of-way except in those areas specifically designated <br /> 13 to permit animals; animals must be confined to such <br /> restricted areas. Exception: Domestic cats. <br /> 14 <br /> 4. Fail to keep a vicious animal confined within a building or <br /> 15 secure enclosure or securely muzzled and leashed or caged <br /> whenever off the premises of its owner. <br /> 16 <br /> 5. Fail to keep every female dog or cat in heat confined in a <br /> 17 building or secure enclosure in such a manner that such <br /> female dog or cat cannot come into contact with another <br /> 18 animal except for planned breeding. <br /> 19 6. Permit any animal to cause annoyance, alarm or noise <br /> disturbance at any time of the day or night, by repeated <br /> 20 barking, whining, screeching, howling, caterwauling, <br /> crowing, braying or other like sounds which extend beyond <br /> 21 the boundary of the owner's property. <br /> 22 7. Fail to provide an animal with sufficient good and <br /> wholesome food and water, proper shelter and protection <br /> 23 from the weather, veterinary care when needed to prevent <br /> suffering, and with humane care and treatment. <br /> 24 <br /> 8. Leave an animal unattended for more than 24 consecutive <br /> 25 hours without adequate care. <br /> 26 9. Abandon an animal. <br /> 27 10. Confine an animal within or on a motor vehicle at any <br /> location under such conditions as may endanger the health <br /> 28 or well being of the animal, including but not limited to <br /> extreme termperatures, lack of food, water or attention, or <br /> 29 confinement with a dangerous animal. Any animal control <br /> or peace officer is authorized to remove any animal from a <br /> 30 motor vehicle, at any location, when he/she reasonably <br /> believes it is confined in such conditions as described above. <br /> 31 Any animal so removed shall be delivered to the Animal <br /> Control Shelter after the removing officer leaves written <br /> 32 <br /> 2 <br />
