Au/- <br /> 2 <br /> c /-2 <br /> AN ORDINANCE establishing minimum safety standards of a railroad <br /> 3 with regard to crossings of City streets, alleys and public places. <br /> 4 <br /> 5 WHEREAS, the City Council of the City of Everett, a first class city under the <br /> 6 laws of the State of Washington, finds that minimum safety standards for railroad <br /> 7 crossings of streets, alleys and public places should be established; <br /> 8 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 9 Section 1: DEFINITIONS. <br /> 10 1. "City Council" - The term City Council or Council when used in this <br /> 11 chapter shall mean the City Council of the City of Everett. <br /> 12 2. "Street" - The term street when used in this chapter includes all street, <br /> 13 alleys, avenues, boulevards, parkways and other public places actually open and in use <br /> 14 or to be open and use for travel by the public in the City of Everett. <br /> 15 3. "Railroad" - When used in this chapter, railroad means every railroad in <br /> 16 the City of Everett, including interurban and suburban electric railroads, by whatsoever <br /> 17 power operated, for the public use in the conveyance of persons or property for hire, <br /> 18 with all bridges, ferries, tunnels, equipment, switches, spurs, sidings, tracks, stations, <br /> 19 and terminal facilities of every kind used, operated, controlled, managed or owned by or <br /> 20 in connection therewith. <br /> 21 4. "Railroad company" - The term railroad company when used in this <br /> 22 chapter includes every corporation, company, association, joint stock association, <br /> 23 partnership or person, its, their or his lessees, trustees or receivers appointed by any <br /> 24 court whatsoever owning, operating, controlling or managing any railroad. <br /> 25 5. "Overcrossing" - The term overcrossing means any point or place where a <br /> 26 street crosses a railroad by passing above the same. <br /> 27 6. "Undercrossing" - The term undercrossing when used in this chapter <br /> 28 means any point or place where a street crosses a railroad by passing under the same. <br /> 29 7. "Grade crossing" - The term grade crossing when used in this chapter <br /> 30 means any point or place where a railroad crosses a street or a street crosses a railroad <br /> 31 or a railroad crosses another at a common grade. <br /> 32 <br />
