• <br /> 1 8. "Crossing" - The term crossing means an overcrossing, undercrossing or <br /> 2 grade crossing. <br /> 3 Section 2: MAINTENANCE OF GRADE CROSSINGS. <br /> 4 All grade crossings by railroads in the City of Everett shall be maintained by the <br /> 5 railroad company with proper signal warnings, flag men, interlocking devices and other <br /> 6 devices or means to secure the safety of the public and shall conform to current <br /> 7 specifications of the Washington State Department of Transportation as set forth in <br /> 8 § 341.02 of the Design Manual of the Washington State Department of Transportation, <br /> 9 M22-01 (HR), May, 1982, and Appendix A of the Design Standards for Urban Arterials in <br /> 10 the State of Washington, July 30, 1981, UAB, which is hereby adopted by reference and <br /> 11 filed with the City Clerk in accordance with § 3.5 of the Charter of the City of <br /> 12 Everett. <br /> 13 Section 3: MAINTENANCE OF UNDERCROSSINGS AND OVERCROSSINGS. <br /> 14 A. The framework and abutments of all overcrossings and the framework and <br /> 15 abutments and deck structure of all undercrossings shall be maintained and kept in <br /> 16 repair by the railroad company and the street thereover or thereunder shall be <br /> 17 maintained and kept in repair by the City. <br /> 18 B. Said framework and abutments of all overcrossings shall be maintained by <br /> 19 the railroad company to support live loadings on the deck of not less than HS 20-44 in <br /> 20 accordance with the "Standard Specifications for Highway Bridges" Thirteenth Edition, <br /> 21 1983, American Association of State Highway and Transportation Officials which is <br /> 22 hereby adopted by reference and filed with the City Clerk in accordance with § 3.5 of <br /> 23 the Charter of the City of Everett. <br /> 24 The railroad company shall have one year after notice from the Mayor to do so <br /> 25 to bring any nonconforming bridges to said standard. <br /> 26 Section 4: ENFORCEMENT. <br /> 27 A. The Mayor may file with the City Council a petition in writing stating <br /> 28 that a crossing in the City does not conform to the standards herein and an <br /> 29 improvement in the method and manner of such crossing, and its approaches, or in the <br /> 30 style and nature of construction of any existing overcrossing, undercrossing or grade <br /> 31 crossing or the closing or discontinuance of an existing street crossing and the diversion <br /> 32 of travel thereon to another street or crossing, or, if not practicable, to change such <br /> 2 <br />
