7. The modification to the approved Site Plan under the Development Agreement and PDO <br /> rezone to allow for the proposed Project are determined to be in the best long-term interest of the <br /> community based upon the following findings: <br /> a. The previous Snohomish County Campus Redevelopment Initiative which is the <br /> subject of the existing Development Agreement and PDO rezone were previously <br /> determined to bear a substantial relation to the public health, safety or welfare, and <br /> promote the best long-term interests of the Everett community; <br /> b. The existing 1967 Snohomish County Superior Courthouse is a fundamental element <br /> of the existing Development Agreement and approved PDO rezone and provides essential <br /> public services to the community at large consisting of Superior Court and District Court <br /> services (including judiciary, commissioners and administration); Sherriff s Office <br /> (including licensing and registration, investigations and administration); and County <br /> Clerk; <br /> c. The proposed Courthouse Modernization Project will substantially prolong the useful <br /> life and functioning of the existing Courthouse and enhance public safety and security by <br /> providing seismic reinforcement for the existing structure and expanded space for <br /> modern security screening and public circulation and access corridors consistent with <br /> modern security protocols for courthouses and compliance with public accessibility <br /> requirements; <br /> d. In accordance with the Project Narrative attached hereto as Exhibit A,the proposed <br /> Courthouse Modernization Project will not expand or otherwise change the use or <br /> occupancy of the existing Courthouse other than to enhance the efficiency and <br /> functionality of the existing Courthouse and allow for expanded security screening and <br /> public access and circulation corridors. Accordingly,the proposed Courthouse <br /> Modernization Project will not generate any new or increased impacts relating to use, <br /> occupancy or traffic generation associated with the Property beyond those approved and <br /> mitigated under the existing Development Agreement and PDO rezone; <br /> e. The Responsible Official has determined that the proposed Courthouse Modernization <br /> Project is consistent with the development and/or redevelopment contemplated in the <br /> City's"Downtown Everett Planned Action" Ordinance No. 3128-09 for which the City <br /> has previously performed environmental review under the State Environmental Policy <br /> Act(SEPA), Ch. 43.21C RCW. In addition thereto,the City of Everett previously issued <br /> a Final Supplemental Environmental Impact Statement dated August 12, 2002 (FSEIS), <br /> evaluating the impacts of the original 2002 Campus Redevelopment Initiative, and has <br /> issued Addendum No. 1 to said FSEIS dated August 1, 2017, addressing the impacts <br /> relating to the proposed amendment of the PDO master plan as set forth herein and <br /> concluded that the impacts fall within the range of impacts addressed in the FSEIS dated <br /> August 12, 2002. <br /> Page 2 of 12 <br />
