NOW, THEREFORE,the parties herein do mutually agree to amend the Development <br /> Agreement as follows: <br /> 3.4 APPROVED DEVELOPMENT: A new sub-section 10 shall be added as follows: <br /> 10. Courthouse Entry Tower: A new five-story entry tower will be developed abutting <br /> the North face of the existing courthouse occupying a surface area of approximately <br /> 5,900 square feet and containing approximately 30,000 square feet of internal building <br /> space. Architectural design shall be compatible with other new and existing campus <br /> building and generally consistent with those elevation drawings attached hereto as <br /> Exhibit C(to be added to the Development Agreement as Attachment D 1-3). <br /> 3.6 SITE PLAN: The Site Plan attached as Attachment A to the Development Agreement shall <br /> be replaced and superseded by that First Amended Site Plan attached hereto as Exhibit B. <br /> 3.7 TRANSPORTATION IMPROVEMENTS: The following paragraph shall be added at the <br /> end to Section 3.7: <br /> An updated"Snohomish County Courthouse Modernization Traffic and Parking <br /> Evaluation"was completed by Gibson Traffic Consultants dated July 2017 for the <br /> Courthouse Modernization Project which is the subject of that First Amendment to <br /> Development Agreement. Said updated study is adopted by reference as Attachment C-1 <br /> to this Agreement and shall supplement that existing Traffic Impact Analysis (TIA) <br /> which is attached as Attachment C to this Agreement. It is recognized and understood <br /> that the Courthouse Modernization Project is not anticipated to generate any increased <br /> use, occupancy or traffic generation associated with the Snohomish County Courthouse. <br /> Accordingly, no additional traffic impact mitigation fees or parking improvements shall <br /> be required as a condition of approval of the Courthouse Modernization Project. <br /> 4.3 SEPA: The following paragraph shall be added at the end to Section 4.3: <br /> The City of Everett, as the Responsible Official, has determined that the proposed <br /> Courthouse Modernization Project is consistent with the development and/or <br /> redevelopment contemplated in the City's"Downtown Everett Planned Action" <br /> Ordinance No. 3128-09 for which the City has previously performed environmental <br /> review under the State Environmental Policy Act (SEPA), Ch. 43.21C RCW. In addition <br /> thereto,the City of Everett previously issued a Final Supplemental Environmental Impact <br /> Statement dated August 12, 2002 (FSEIS), evaluating the impacts of the original 2002 <br /> Campus Redevelopment Initiative, and concurrent herewith has issued Addendum No. 1 <br /> to said FSEIS dated August 1, 2017, addressing the impacts relating to the proposed <br /> Courthouse Modernization Project and concluded that the impacts fall within the range of <br /> impacts addressed in the FSEIS dated August 12, 2002. <br /> Page 3 of 12 <br />
