• • . <br /> 2. All developments shall comply with other local, state and federal regulations relating to <br /> critical areas,as applicable. <br /> 3. Best available science shall be used in identifying, evaluating and mitigating impacts of <br /> development proposals. The City shall require sufficient geological,hydrological and biological <br /> studies to determine the impacts of the proposal. (See EMC 19.37 and Planning Director <br /> Interpretation No.2-2000 in Appendix A.) <br /> Comment: Potential impacts to threatened and endangered species have been evaluated in a <br /> Biological Assessment (Pentec, August 26, 2013) and appropriate construction protocols are <br /> being developed in conjunction with the Corps of Engineers to minimize and/or avoid <br /> construction related impacts. <br /> 34. Construction sites and on-going activities involved in the handling and storage of fuel, <br /> chemicals,oil and other substances with the potential for spillage into adjacent waters, shall have <br /> operational procedures to prevent and handle potential spills. In addition physical structures <br /> which would contain any potential spills shall also be provided. Procedures shall meet <br /> applicable local,state and federal requirements. <br /> Comment: The proposal must use best management practices. <br /> Section 5—Use Regulations <br /> 6.7 Piers,Docks and Floats <br /> General <br /> 3. Piers, docks, and floats shall be located, designed, and constructed so as to cause minimum <br /> interference with navigation and public use of the water surface and shoreline; to mitigate the <br /> impacts to ecological functions and critical areas, such as eelgrass beds and fish habitats (see the <br /> definition of mitigation sequencing); to avoid or minimize impacts to processes such as tidal <br /> currents and littoral drift; to minimize impacts on views; and to cause no undue harm to adjacent <br /> properties. Piers, docks and floats shall be the minimum size and height necessary to meet the <br /> needs of the proposed use. <br /> 4. Proposals for piers and docks shall include the following: the purpose of the project; <br /> description of the proposed structure (size, location relative to property lines and OHWM, <br /> design, and materials); any shoreline modification required; ownership of the lands; location, <br /> width, height and length of piers or docks on adjacent properties within three hundred feet; and <br /> sufficient studies,as determined by the planning director,to analyze the impacts of the proposal. <br /> Comment: The footprint of the existing wharf will not be increased. <br /> 5. Overhead wiring and plumbing shall be prohibited on piers or docks. <br /> Comment: No overhead wiring or plumbing is proposed. <br />
