DECISION <br /> Based upon the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, it is hereby ordered that the requested <br /> Shoreline Permit, Reasonable Use Exception and Conditional Use for the expansion of <br /> an iron works facility to be completed at 2102 Ross Avenue, Everett, Washington, is <br /> granted subject to conditions listed below. The project includes the addition of a 5,280 <br /> square foot wharf; a 12,650 square foot staging area; a 12,750 square foot office and <br /> shop building and a reduction of a shoreline buffer. <br /> 1. The site and building construction plans must comply with all pertinent City <br /> standards and requirements, whether or not specifically set forth herein. <br /> 2. The construction, or substantial progress toward construction of the project in <br /> reliance of the issued Shoreline Permit, must be undertaken within two years after <br /> final approval of the permit and completed within five years, except as otherwise <br /> provided by the City Shoreline Master Program and regulations. <br /> 3. All exterior lighting, including lighting of signs, shall be directed downward onto the <br /> site and away from other shoreline properties or nearby neighborhoods. Lighting <br /> shall be directed downward onto the site and away from environmentally sensitive <br /> areas and their buffers. <br /> 4. All shoreline development is subject to the City's Noise Ordinances. The Applicant <br /> may exercise all allowed exceptions to the noise standards. The process, as set <br /> forth in EMC 20.08.100(B), will apply. <br /> 5. The Shoreline Permit, as proposed, must be located, constructed and operated in <br /> a manner that does not create a hazard to public health and safety. <br /> 6. The Applicant's landscape plan that was submitted at the hearing (exhibit 16) is <br /> allowed for the placement of landscaping on-site. However, the following must be <br /> adhered to: <br /> a. a five-foot landscape strip is to be located along the west lot line, rather than <br /> the 20-foot width required by the zoning code. There is a City waterline at <br /> this location, and the City strongly discourages trees from being planted <br /> near City waterlines. <br /> b. the Applicant shall place up to five-feet of the required 15-foot wide <br /> landscape strip within the City right-of-way. This placement will be <br /> consistent with what has previously been permitted for the existing <br /> development. The City has no future plans to install sidewalks along Ross <br /> Avenue, and there is adequate right-of-way width for a future trail. <br /> 7. The Applicant, or its successors, must immediately stop work and notify the City <br /> and the Tulalip Tribes if anything of possible archaeological interest is uncovered <br /> 13 <br />
