during excavations or development. Further, the Applicant, or its successors, must <br /> consult a professional archaeologist to inspect and evaluate the site if any possible <br /> archaeological interest is uncovered. Failure to comply with this requirement shall <br /> be considered a violation of the Shoreline Permit. <br /> 8. The Applicant, or its successors, shall obtain a Floodplain Development Permit <br /> prior to any work being done on-site. <br /> 9. The Applicant, or its successors, shall pay a fee of 2% of construction costs of the <br /> proposed development prior to the issuance of building permits. The fee shall be <br /> in lieu of providing any direct public shoreline access to the site. <br /> 10. The proposed project shall comply with all local, state and federal regulations as <br /> they relate to critical areas. <br /> 11 . The proposed project must comply with the Washington State Department of <br /> Ecology's 2012 Stormwater Management Manual for Western Washington. <br /> 12. Any plantings that occur within environmentally sensitive areas and their buffers <br /> must be of native species or native-hybrids. No other plantings shall be allowed. <br /> 13. Whenever feasible, construction staging areas shall be located outside <br /> environmentally sensitive areas and buffers as defined in the Shoreline Master <br /> Program. <br /> 14. The Applicant shall provide a third-year monitoring report of the effectiveness of <br /> the existing facility. The report shall identify any shoreline impacts from the <br /> proposed development. <br /> 15. A five-year set-aside to cover the costs of monitoring, maintenance and <br /> contingencies, including fifty percent of the cost of the plantings shall be provided <br /> by the Applicant. Monitoring reports are to be submitted at the end of year one, <br /> year three, and year five following the installation. Contingencies relating to the <br /> landscaping must be implemented based upon the findings of the monitoring. The <br /> City may release the set-aside sooner than five years if the enhancement is <br /> determined by the City to be successful. <br /> 16. Construction sites and on-going activities involved in the handling and storage of <br /> fuel, chemicals, oil and other substances with the potential for spillage into <br /> adjacent waters shall have operational procedures to prevent and handle potential <br /> spills. Physical structures which would contain any potential spills shall also be <br /> provided. Procedures shall meet applicable local, state and federal requirements. <br /> The best management practices and procedures shall be employed for safe <br /> handling of fuels and toxic or hazardous materials. Operators shall take all actions <br /> necessary to ensure that contaminants do not enter the water or storm drainage <br /> system. <br /> 14 <br />
