A1$D \� n-se ih� ts�oS �«gr,�GiRrs \ SooJ�r�T.iw. v <br /> TO: Mayor Stephanson /��+ ) <br /> FROM: Sharon Marks, City Clerk <br /> Soojin Kim, Legal <br /> DATE: <br /> SUBJECT: Corrections to Ordinance No. 3002-07 <br /> Ordinance No. 3002-07 amended the Zoning Code to modify permitted use and development <br /> standards in the Waterfront Commercial Zone, the zone requested by OliverMcMillan for the <br /> riverfront properties, and Jeld-Wen for their waterfront properties. The Ordinance was approved <br /> by City Council on July 11, 2007 and became effective on July 27, 2007. <br /> The attached corrected ordinance provided for your signature includes the following corrections: <br /> 1. Sections 2, 3, 4, 5 and 6 of the Ordinance only cited a portion of the existing EMC <br /> (Zoning Code) sections that were being amended. The City Charter requires that the <br /> entire section be included. The attached corrected ordinance includes the text of the <br /> entire EMC sections that are being amended. This is a formatting issue/clerical error <br /> and does not change the intent or outcome of the ordinance. <br /> 2. The first sentence of Sections 2, 3, 4, 5 and 6 of the Ordinance have been modified to cite <br /> the number of the most-recent ordinance amending the original ordinance, rather than just <br /> citing the original ordinance, "as amended." These corrections to the ordinance <br /> references provide better tracking of changes to the EMC and do not change the intent or <br /> outcome of the ordinance. <br /> 3. Section 2 of the Ordinance included a misquote of the wording in the existing EMC: <br /> Table 5.1 Special Regulations 5, 7 and 9 were not quoted correctly in the ordinance. The <br /> amended version of the section included the same misquoted language. There was no <br /> intent to change the special regulations. In the attached corrected ordinance they are <br /> shown as in the adopted EMC, with no changes. <br /> 4. Section 3 of the ordinance added a footnote 66 to Table 5.2. The footnote should have <br /> been numbered 67,rather than 66. <br /> Section 10 of the ordinance allows the City Clerk to make corrections to the ordinance to correct <br /> clerical errors, references, ordinance numbering, section/subsection numbers and any references <br /> thereto. All of the changes listed above fall within the provisions of Section 10 and do not affect <br /> the intent, meaning, or outcome of the ordinance. <br />
