Section 4: Amendments to the International Building Code and International <br /> Residential Code <br /> A. Section 101 of the 2006 Editions of the IBC and IRC are hereby amended by <br /> inserting "the City of Everett." <br /> B. Section 101.3 of the 2006 Editions of the IBC and IRC are hereby amended by <br /> the addition of the following language: <br /> It is the specific intent of this Code to place the obligation of complying <br /> with its requirements upon the permit applicant and any person owning, <br /> operating or controlling any building or structure within its scope and no <br /> provision nor term used in this Code is intended to impose any duty <br /> whatsoever upon the City or any of its officers or employees for whom the <br /> implementation or enforcement of this Code shall be discretionary and not <br /> mandatory. <br /> Nothing contained in this Code is intended to be nor shall be construed to <br /> create or form this basis for any liability on the part of this City or its <br /> officers, employees or agents, for any injury or damage resulting from the <br /> failure of a building to comply with the provisions of this Code, or be <br /> reason or consequence of any inspection, notice, order certificate, <br /> permission or approval authorized or issued or done in connection with the <br /> implementation or enforcement of this Code, or by reason of any action of <br /> the City related in any manner to the enforcement of this Code by its <br /> officers, employees or agents. <br /> Notwithstanding any language used in this Code, it is not the intent of this <br /> code to create a duty and/or cause of action running to any individual or <br /> identifiable person but rather any duty is intended to run only to the <br /> general public. <br /> C. Section 101.4.1 of the 2006 Edition of the IBC—Electrical. The National <br /> Electrical Code as adopted by Chapter 16.05 of this code shall apply to the <br /> installation of electrical systems, including alterations, repairs, replacement, <br /> equipment, appliances, fixtures, fittings and appurtenances thereto. <br /> D. Section 101.4.4 of the 2006 Edition of the IBC—Plumbing. The provisions of <br /> the Uniform Plumbing Code as adopted by Chapter 16.04 of this code shall apply <br /> to the installation, alteration, repair and replacement of plumbing systems, <br /> including equipment, appliances, fixtures, fittings and appurtenances, and where <br /> connected to a water or sewage system and all aspects of a medical gas system. <br /> The provisions of the state of Washington requirements for private sewage <br /> disposal shall apply to private sewage disposal systems. <br /> E. Section 101.4.5 of the 2006 Edition of the IBC—Property Maintenance. <br /> Delete. <br /> F. Section 101.4.7 of the 2006 Edition of the IBC—Energy. The provisions of the <br /> State of Washington Energy Code adopted by the City of Everett and the State of <br /> Washington Ventilation and Indoor Air Quality Code adopted by Chapter 16.10 <br /> of this code shall apply to all matters governing the design and construction of <br /> buildings for energy efficiency. <br /> G. Section 102.6 of the 2006 Edition of the IBC—Existing Structures. Delete <br /> "The International Property Maintenance Code or." <br /> -2- <br />
