Section 4: Amendments to the International Building Code and International Residential Code A. Section 101 of the 2006 Editions of the IBC and IRC are hereby amended by inserting "the City of Everett." B. Section 101.3 of the 2006 Editions of the IBC and IRC are hereby amended by the addition of the following language: It is the specific intent of this Code to place the obligation of complying with its requirements upon the permit applicant and any person owning, operating or controlling any building or structure within its scope and no provision nor term used in this Code is intended to impose any duty whatsoever upon the City or any of its officers or employees for whom the implementation or enforcement of this Code shall be discretionary and not mandatory. Nothing contained in this Code is intended to be nor shall be construed to create or form this basis for any liability on the part of this City or its officers, employees or agents, for any injury or damage resulting from the failure of a building to comply with the provisions of this Code, or be reason or consequence of any inspection, notice, order certificate, permission or approval authorized or issued or done in connection with the implementation or enforcement of this Code, or by reason of any action of the City related in any manner to the enforcement of this Code by its officers, employees or agents. Notwithstanding any language used in this Code, it is not the intent of this code to create a duty and/or cause of action running to any individual or identifiable person but rather any duty is intended to run only to the general public. C. Section 101.4.1 of the 2006 Edition of the IBC—Electrical. The National Electrical Code as adopted by Chapter 16.05 of this code shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and appurtenances thereto. D. Section 101.4.4 of the 2006 Edition of the IBC—Plumbing. The provisions of the Uniform Plumbing Code as adopted by Chapter 16.04 of this code shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system. The provisions of the state of Washington requirements for private sewage disposal shall apply to private sewage disposal systems. E. Section 101.4.5 of the 2006 Edition of the IBC—Property Maintenance. Delete. F. Section 101.4.7 of the 2006 Edition of the IBC—Energy. The provisions of the State of Washington Energy Code adopted by the City of Everett and the State of Washington Ventilation and Indoor Air Quality Code adopted by Chapter 16.10 of this code shall apply to all matters governing the design and construction of buildings for energy efficiency. G. Section 102.6 of the 2006 Edition of the IBC—Existing Structures. Delete "The International Property Maintenance Code or." -2-
