80-6 STOP ORDERS. Whenever any work is being done contrary to the <br /> provisions of this Code, the Building Official may order the work stopped by <br /> notice in writing served on any persons engaged in doing or causing such work to <br /> be done and any such persons shall forthwith stop such work until authorized by <br /> the Building Official to proceed with the work. <br /> 80-7 LIABILITY. The Building Official or any employee charged with the <br /> enforcement of this Code, acting in good faith and without malice for the City in <br /> the discharge of his/her duties, shall not thereby render himself liable personally <br /> and he is hereby relieved from all personal liability for any damage that may <br /> accrue to person or property as a result of any act required or by reason of any act <br /> or omission in the discharge of his/her duties. In the event there is made against <br /> such officers or employees any claims and/or litigation arising from any conduct, <br /> acts or omissions of such officers or employees in the scope and course of their <br /> City employment, the City Attorney shall, at the request of or on behalf of the <br /> officer or employee, investigate and defend such claims and/or litigation and, if a <br /> claim be deemed by the City Attorney a proper one or if judgment be rendered <br /> against such officer or employee, the claim or judgment shall be paid by the City <br /> in accordance with procedures established for the settlement of claims and <br /> payment of judgments. This code is one of general application and nothing herein <br /> is intended to create liability or cause action running in favor of individual <br /> members of the public. <br /> 80-8 UNSAFE CONDITIONS. All electrical wires, equipment and apparatus <br /> which are unsafe or not provided with adequate safeguards, or which constitute a <br /> fire hazard, or are otherwise dangerous to human life, or which in relation to <br /> existing use constitute a hazard to safety or health, or public welfare by reason of <br /> inadequate maintenance, obsolescence, fire hazard, disaster damage, or <br /> abandonment, as specified in this Code or any other effective ordinance arm for <br /> the purpose of this section, considered unsafe conditions. All such unsafe <br /> conditions are hereby declared to be public nuisances and the owner or his agent <br /> must abate by repair, rehabilitation, demolition, or removal in accordance with <br /> this Code or by any other procedures provided by law. <br /> 80-9 BOARD OF REVIEW. For the purpose of determining suitable alternate <br /> materials, alternate types and methods of construction and reasonable <br /> interpretations regarding the National Electrical Code, any person aggrieved by an <br /> order or action of the Building Official who does not have an enforcement <br /> procedure pending pursuant to Chapter 1.20 EMC, may file a written request <br /> with the City Clerk requesting a determination by the Board of Review. The <br /> aggrieved party must file such request within thirty calendar days from the date of <br /> receipt of the written order and shall cause to be made at his own expense, any <br /> test or research required to substantiate the request. The Board shall not have any <br /> authority to waive the requirements of this Code, but may approve plans and a <br /> time frame for bringing an existing building into compliance with this Code's <br /> requirements, provided that time frame does not exceed one year. <br /> 80-10 VIOLATION. It shall be unlawful for any person, firm, or corporation to <br /> install, alter or extend any electrical equipment in the City, or cause the same to <br /> be done, contrary to or in violation of any of the provisions of this Code. <br /> -3- <br />
