She encouraged Commission to <br /> recommend approval of the code amendment. <br /> Howie Bargreen, 2821 Rucker, stated that he was concerned about treating an opiate substitution <br /> treatment facility as a medical clinic use. He stated that all of the surrounding cities appear to be <br /> keeping these types of facilities out of their communities. He felt that the community should focus on <br /> getting rid of the drug problem altogether. He stated that Singapore and Portugal have cut their drug <br /> addiction to 75%. He added that the City should focus on how to get rid of the problem. <br /> Daniel Meins, 2431 Harrison Avenue, distributed his schematics to Commission on a one-night stay safe <br /> haven hostel that would provide services for the homeless. He presented the idea to Commission. <br /> Shannon Swanson Myers,General Manager for the Courtyard Marriot, does not support an opiate <br /> substitution treatment facility in the downtown area. <br /> Michelle Fessler, 2229 Colby Avenue, was in favor of allowing a second opiate substitution treatment <br /> facility. She stated that a second treatment facility where the need is greatest is one of the many <br /> important steps to finding a solution. <br /> Motion: Commissioner Beck made a motion to close the public hearing. Commissioner Lavra seconded <br /> the motion. <br /> Vote: Commissioner Yanasak,yes; Commissioner Lavra, yes; Commissioner Zelinski, yes; Commissioner <br /> Beck,yes; Commissioner Jordison,yes; Commissioner Tisdel,yes; and Chair Holland,yes. <br /> Motion Carried. <br /> Commission Discussion <br /> Chair Holland referred to the options to prohibit clinics in the B-3 zone or on the ground floor on <br /> designated retail streets and asked Mr.Giffen if the City had notified the medical clinic uses already <br /> located in the B-3 zone regarding their nonconforming use potential. Mr. Giffen responded no, unless <br /> they were already included in the general distribution list. <br /> Commissioner Lark asked about the nonconforming options. Mr. Giffen responded that under option 1, <br /> all the existing clinics would become nonconforming. Under option 2, only the clinics located on the <br /> ground floor on a designated retail street would be nonconforming. <br /> Commissioner Beck didn't support adopting either of the options. <br /> Commissioner Jordison referred to the letter from David Hall regarding discrimination under the <br /> Americans with Disabilities Act and Rehabilitation Act and stated that he supported the staff resolution. <br />
