Commissioner Yanasak stated that as an attorney he came to the same conclusion addressed in David <br /> Hall's memo. <br /> Commissioner Zelinski stated that he supported the resolution; however, he was sensitive to downtown <br /> business concerns. He didn't support prohibiting medical clinics in the B-3 zone but would like to <br /> consider other options such as the conditional use process as the City moves forward with the review of <br /> the Metro Everett Subarea Plan. <br /> Commissioner Beck stated that everyone was sensitive to downtown issues; however,the resolution as <br /> written would remove the stigma from the zoning code and would treat opiate substitution treatment <br /> facilities as any other medical use. The code amendment does not address a specific site. <br /> Commissioner Lark stated that he was sensitive to the needs of the downtown community but also the <br /> need to help people,which is the right thing to do. He agreed with Commissioner Zelinski that during <br /> the Metro Everett planning process,there could be other ways to address the issue including finding <br /> ways to start building on the strengths of downtown,to start building on the strengths of the businesses <br /> that exist in downtown, and working to empower them to make sure that they are successful. <br /> Commissioner Tisdel stated that he wasn't against any protected class but wouldn't support the <br /> resolution because of perception which does impact existing businesses and potential businesses that <br /> may want to move into the area. He supported working on a solution but didn't want to hamper the <br /> investment that many businesses have made in Everett and the downtown area. <br /> Motion: Commissioner Lavra made a motion to approve Resolution 17-08 as recommended by staff. <br /> Commissioner Beck seconded the motion. <br /> Vote: Commissioner Yanasak,yes;Commissioner Lavra, yes; Commissioner Zelinski,yes; Commissioner <br /> Beck,yes; Commissioner Jordison,yes; Commissioner Tisdel, no; and Chair Holland,yes. <br /> Motion Carried. <br />
