1.2 Mitigation Required by Existing Regulations <br /> All development must comply with the regulations and standards in effect at time of application, except <br /> as otherwise provided in this Mitigation Decision Document, including, but not limited to, the <br /> following: <br /> City of Everett <br /> Zoning Code (EMC Title 19) <br /> (Note that some standards may not apply to projects with previous approvals.) <br /> Drainage Ordinance and Stormwater Management Manual (Ordinance 2196-97) <br /> Design and Construction Standards and Specifications for Development Manual <br /> Binding Site Plan and Subdivision Ordinances (EMC Title 18) <br /> Federal Aviation Authority (FAA) Regulations <br /> Federal Air Regulation Part 77 and FAA Advisory Circular AC 70/7460-21 (Proposed Construction or <br /> Alteration of Objects that may Affect the Navigable Airspace) <br /> 1.3 Mitigation Measures <br /> 1. Height: All development with structures more than 200 feet in height and those within 20,000 feet of <br /> Paine Field must check with the FAA to determine if notification is required. (SEPA Land and <br /> Shoreline Use Policies) <br /> 2. Where buffers are required adjacent to residential areas, an analysis of hazardous trees in the <br /> buffer must be completed by a professional arborist. Any trees that are hazardous (i.e., are <br /> diseased, damaged or leaning and are likely to fall on development) must be removed prior to <br /> issuance of occupancy permits, and preferably, prior to construction of structures on the site. <br /> Where they would not create a hazard, the trunks of these trees must be left for snags. For each <br /> tree cut, three coniferous trees must be planted unless the Planning Director determines that <br /> adequate screening exists without the additional trees. However, for each tree left as a snag, one <br /> coniferous tree must be planted. The arborist must submit a tree removal and replacement plan to <br /> the Planning Department and mark in the field all trees to be removed. The Planning Department <br /> must approve the tree removal and replacement plan prior to any activity in the environmentally <br /> sensitive area. Large woody debris should be retained where it would not create a hazard, such as <br /> causing flooding due to alteration of the natural hydrology of a stream system. (SEPA Plant and <br /> Animal Policies and Land and Shoreline Use Policies) <br /> 3. Mukilteo School District Property. The City should revise the Zoning Code to eliminate <br /> requirements for Special Property Use hearings on the Mukilteo School District property for <br /> expansions or modifications to School District uses, since sensitive land uses are not located <br /> adjacent to the property. (SEPA Land and Shoreline Use Policies) <br /> 4. Views. When approving buffers adjacent to residential areas that allow views through the buffers <br /> from the development, the Planning Director shall ensure that the development will be substantially <br /> obscured from the residential areas.
