This analysis does not cover any structure that the FAA determines may have a significant adverse <br /> affect on navigable airspace around Paine Field Airport. <br /> 8.5.2 Mitigation Required by Existing Regulations <br /> All development must comply with the regulations and standards in effect at time of application, except <br /> as otherwise provided in this Mitigation Decision Document, including, but not limited to, the <br /> following: <br /> City of Everett <br /> Public Works Design and Construction Standards and Specifications Manual <br /> Subdivision and Binding Site Plan Ordinances (EMC Title 18) <br /> Zoning Code (EMC Title 19) <br /> Federal Aviation Authority (FAA) <br /> Federal Air Regulation Part 77 and FAA Advisory Circular AC 70/7460-21 (Proposed Construction or <br /> Alteration of Objects that may Affect the Navigable Airspace). <br /> Other <br /> Telephone service is regulated by the Washington Utilities and Transportation Commission (WUTC) <br /> and the Federal Communication Commission (FCC). <br /> Cable services are regulated by the Nation Cable Television Association guidelines and the FCC. <br /> 8.5.3 Mitigation Measures <br /> 1. All communication lines must be installed underground. (SEPA Public Services and Land and <br /> Shoreline Use Policies) <br /> 2. The Special Property Use permit process for aboveground utilities must include analysis of impacts <br /> to views from the proposed facilities. In addition, Special Property Use permits should only be <br /> approved when the design of the aboveground communication facilities are compatible with nearby <br /> structures and/or screened from view. (SEPA Public Services and Land and Shoreline Use <br /> Policies) <br /> 3. Antennae and tower proposals and all proposals for structures to be added to the top of existing <br /> buildings: the FAA must be notified prior to issuance of a determination of consistency to <br /> determine if the structure will affect navigable airspace. All recommendations of the FAA must be <br /> complied with. (SEPA Land and Shoreline Use Policies) <br /> 42 <br />
