4411 . <br /> ORDINANCE NO.3582-17 404W <br /> —Alk. <br /> Ordinance establishing a Downtown Business Improvement <br /> Area(BIA):providing for the levy of a special assessment upon real <br /> property (and the owners thereof) within the area: the deposit of <br /> revenues in a special account and expenditures therefrom;providing <br /> for an implementing agreement with a downtown Everett property <br /> owners association or similar organization,and repealing Ordinance <br /> 2842-05. <br /> Whereas, the City Council adopted Resolution No. 7183 on November 15, 2017. declaring its <br /> intent to initiate and establish a new Downtown Everett Business Improvement Area (DIA) <br /> pursuant to Chapter 35.87A RCW, and disestablish,terminate,and dissolve the old BR; and <br /> Whereas,the City Council,on December 13,2017,adopted Resolution No. 7193,disestablishing, <br /> terminating, and dissolving the present existing BIA upon the establishment of a new BIA and <br /> initiating a new Downtown Everett BIA; and <br /> Whereas,as provided in Resolution No.7183,the City Council held a public hearing on December <br /> 13. 2017 in the Everett City Hall Council Chambers, concerning the formation of the Downtown <br /> Everett BIA and the imposition of special assessments on property (and property owners) within <br /> such BIA, prior to the adoption of this Ordinance; <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Ordinance Repealed. <br /> ordinance No. 2842-05 is repealed as of the effective date of this Ordinance. <br /> aggikt_i 2. District Established. <br /> As authorized by Chapter 35.87A RCW,there is hereby established a Downtown Everett Business <br /> improvement Arca (BIA) within the following described boundaries (when a street or alley is <br /> named. the District boundary is the center line of the right-of-way unless otherwise stated): <br /> Beginning at the intersection of the centerline of Everett Avenue and the centerline of <br /> Broadway Avenue; thence southerly,along the centerline of Broadway Avenue to <br /> intersect the centerline of Pacific Avenue; thence westerly, along the centerline of hellle <br /> Avenue to intersect the centerline of West Marine View Drive (formerly known as <br /> Norton Avenue): thence northerly,along the centerline of West Marine View Drive to <br /> intersect the centerline of Everett Avenue; thence easterly, along the centerline of Everett <br /> Page 1 of 11 <br />
