4411 . ORDINANCE NO.3582-17 404W —Alk. Ordinance establishing a Downtown Business Improvement Area(BIA):providing for the levy of a special assessment upon real property (and the owners thereof) within the area: the deposit of revenues in a special account and expenditures therefrom;providing for an implementing agreement with a downtown Everett property owners association or similar organization,and repealing Ordinance 2842-05. Whereas, the City Council adopted Resolution No. 7183 on November 15, 2017. declaring its intent to initiate and establish a new Downtown Everett Business Improvement Area (DIA) pursuant to Chapter 35.87A RCW, and disestablish,terminate,and dissolve the old BR; and Whereas,the City Council,on December 13,2017,adopted Resolution No. 7193,disestablishing, terminating, and dissolving the present existing BIA upon the establishment of a new BIA and initiating a new Downtown Everett BIA; and Whereas,as provided in Resolution No.7183,the City Council held a public hearing on December 13. 2017 in the Everett City Hall Council Chambers, concerning the formation of the Downtown Everett BIA and the imposition of special assessments on property (and property owners) within such BIA, prior to the adoption of this Ordinance; NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: Section 1. Ordinance Repealed. ordinance No. 2842-05 is repealed as of the effective date of this Ordinance. aggikt_i 2. District Established. As authorized by Chapter 35.87A RCW,there is hereby established a Downtown Everett Business improvement Arca (BIA) within the following described boundaries (when a street or alley is named. the District boundary is the center line of the right-of-way unless otherwise stated): Beginning at the intersection of the centerline of Everett Avenue and the centerline of Broadway Avenue; thence southerly,along the centerline of Broadway Avenue to intersect the centerline of Pacific Avenue; thence westerly, along the centerline of hellle Avenue to intersect the centerline of West Marine View Drive (formerly known as Norton Avenue): thence northerly,along the centerline of West Marine View Drive to intersect the centerline of Everett Avenue; thence easterly, along the centerline of Everett Page 1 of 11
