Ordinance No./c9e)&—p. <br /> An Ordinance amending Ordinance No. 3572 <br /> as amended by Ordinance No. 537-78 which <br /> established Flood Plain Regulations as part <br /> of the Zoning Code. <br /> WHEREAS, on November 28, 1984, City Council adopted interim Flood <br /> Fringe Overlay district regulations to remain in effect until December 31 , <br /> 1985, and <br /> WHEREAS, on December 3, 1985, the Planning Commission held a public <br /> hearing to consider whether said interim regulations should be adopted as <br /> permanent, and <br /> WHEREAS, after reviewing the entire Flood Plain Regulations, Planning <br /> Commission recommended that the interim Flood Fringe overlay district <br /> regulations be adopted as a permanent regulation and minor changes in wording <br /> be made in the Definitions section and Floodway District regulations to <br /> clarify the intent of those sections, and <br /> WHEREAS, City Council finds that since the City has agreed to regulate <br /> flood hazard areas in order to participate in the National Flood Insurance <br /> program and in order to avoid a lapse in regulations, the City Council finds <br /> that an emergency exists, and <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Section 1, Subsection B, Definitions, which now reads as <br /> follows: <br /> B. DEFINITIONS <br /> 1 . Flood Fringe means the portion of the regulatory flood plain beyond the <br /> limits of the floodway. Flood waters in this area are usually shallow <br /> and slow moving. Development is permitted in the flood fringe if <br /> protected from the water of the 100-year flood. <br /> -1- <br />
