• 1 ORDINANCE NO. // 9 7 - 457.5- 2 AN ORDINANCE providing for the licensing of "panorams," "previews," 3 "picture arcades," or "peep shows", amending Ordinance No. 295-74 by the addition of a new chapter and repealing Ordinance No. 4 1125-85 5 6 THE CITY OF EVERETT DOES ORDAIN: 7 Section 1: Ordinance No. 295-74 is hereby amended by the addition of a new 8 chapter regulating "panorams," "previews," "picture arcades" or "peep shows," to be 9 entitled "Panorams, Previews, Picture Arcades and Peep Shows" which chapter shall 10 read as follows: 11 A. Preamble. 12 This chapter is intended to protect the general public health, 13 safety and welfare of the citizenry of the City of Everett through the regulation of the operations of panoram premises. The regulations set 14 forth herein are intended to prevent health and safety problems in and around panoram premises and to prevent dangerous and unlawful conduct 15 in and around panoram premises. 16 B. Definitions. 17 18 As used in this chapter, the following words and phrases shall have the following meanings unless the context clearly requires otherwise: 19 1. "Clerk" means the City Clerk of the City of Everett who is 20 designated by the Mayor as licensing official under this chapter. It also includes his/her designee. 21 2. "Panoram," "preview," "picture arcade" or "peep show," means any 22 device which, for payment of a fee, membership fee, or other charge, is used to exhibit or display a picture, view, or other 23 graphic display. All such devices are denominated in this chapter by the terms "panoram" or "panoram device." The terms panoram 24 and panoram device as used in this chapter do not include games which employ pictures, views or video displays, or gambling devices 25 regulated by the state or by Chapter 5.12 EMC. 26 3. "Panoram Manager" means any person who manages, directs, administers, or is in charge of, the affairs and/or the conduct of 27 any panoram premise. 28 4. "Panoram premise" means any premise on which any panoram device is located and to which members of the public are admitted. 29 The term panoram premise as used in this chapter does not include movie or motion picture theater auditoriums capable of seating 30 more than five people. 31 5. "Panoram station" means the portion of any panoram premises on which a panoram device is located and from which the panoram 32 picture, view or graphic display is to be viewed.
