1 M. Violation a Misdemeanor. <br /> 2 Any person who knowingly violates any of the provisions of this <br /> 3 chapter is guilty of a misdemeanor and upon conviction thereof, shall be <br /> punishable by a fine not to exceed one thousand dollars ($1,000) or <br /> 4 imprisonment in jail not to exceed ninety (90) days, or both imprisonment <br /> and fine. Each separate day or any portion thereof, during which any <br /> 5 violation of any provision of this chapter occurs or continues, shall be <br /> deemed a separate and distinct offense. <br /> 6 <br /> N. Civil Remedies. <br /> 8 The violation of or failure to comply with any of the provisions of <br /> this chapter is declared to be unlawful and a public nuisance. The City <br /> 9 Clerk may seek legal or equitable relief to enjoin any act or practice <br /> which constitutes or will constitute a violation of any regulation herein <br /> 10 adopted. <br /> 11 O. Code Violations and Enforcement. <br /> 12 The remedies provided herein for violations of or failure to comply <br /> 13 with provisions of this ordinance, whether civil or criminal, shall be <br /> cumulative and shall be in addition to any other remedy provided by law. <br /> 14 <br /> 15 P. Conflicting Sections or Provisions. <br /> 16 In the event there is a conflict or inconsistency between the <br /> sections and provisions set forth in this chapter and those set forth <br /> 17 elsewhere in Ordinance No. 295-74 (as amended), the sections and <br /> provisions of this chapter shall govern and supersede those set forth <br /> 18 elsewhere. <br /> 19 <br /> Q. Severability. <br /> 20 If any provision of this chapter shall be declared unconstitutional <br /> 21 or invalid by any court of competent jurisdiction, it shall be conclusively <br /> presumed that this chapter would have been enacted without the provision <br /> 22 so held unconstitutional or invalid and the remainder of this chapter shall <br /> not be affected as a result of said part being held unconstitutional or <br /> 23 invalid. <br /> 24 R. Purpose. <br /> 25 It is expressly the purpose of this chapter to provide for and <br /> 26 promote the health, safety and welfare of the general public, and not to <br /> create or otherwise establish or designate any particular class or group of <br /> 27 persons who will or should be especially protected or benefited by the <br /> terms of this chapter. <br /> 28 It is the specific intent of this chapter that no provision nor any <br /> 29 term used in this chapter is intended to impose any duty whatsoever upon <br /> the City or any of its officers or employees, for whom the implementation <br /> 30 or enforcement of this chapter shall be discretionary and not mandatory. <br /> 31 / / / / / <br /> 32 / / / / / <br /> -7- <br />
