1 2. The building, structure, equipment, operation or location of <br /> the business for which the license was issued does not <br /> 2 comply with the requirements or fails to meet the standards <br /> 3 of this chapter; <br /> 3. The licensee, his or her employee, agent, partner, director, <br /> 4 officer or manager, has violated or permitted violation of <br /> any provisions of this chapter. <br /> 5 <br /> The procedure for revoking or suspending a license under <br /> 6 this chapter shall be the following: Upon determining that <br /> grounds for revocation or suspension exist, the City Clerk <br /> 7 shall send the licensee a notice of intent to revoke or <br /> 8 suspend the license. Said notice shall set forth the grounds <br /> for suspension or revocation and schedule a hearing before <br /> 9 the Clerk or his/her designee. The hearing shall be held no <br /> earlier than three (3) and not later than ten (10) working <br /> 10 days from the date of notice of intent to revoke. The <br /> licensee shall be permitted to present evidence in support of <br /> his position at the hearing. Within two (2) working days <br /> 11 after the hearing, the hearing examiner shall notify the <br /> 12 licensee in writing of his/her determination and reasons <br /> therefor. Should the licensee disagree with the determina- <br /> tion,13 he must file a notice of nonacceptance with the City <br /> Attorney's Office within five (5) working days of receipt of <br /> the hearing examiner's determination. In the event that a <br /> 14 notice of nonacceptance is not filed, the hearing examiner's <br /> determination shall become final and the <br /> 15 suspension/revocation shall be given immediate effect. <br /> 16 The City shall, within five (5) working days following receipt <br /> 17 of a notice of nonacceptance, file a complaint with the <br /> Snohomish County court enjoining the licensee from <br /> 18 operating his business. The burden of proof shall be on the <br /> City. The status quo shall be maintained and the hearing <br /> 19 examiner's determination of revocation or suspension shall <br /> not be effective until a final judicial determination on the <br /> 20 merits affirming the suspension/revocation is rendered. <br /> 21 L. Premises Regulations. <br /> 22 All panoram premises shall conform to the following requirements: <br /> 23 1. The entire interior of the panoram premises shall be arranged in <br /> 24 such a manner that the interior of every panoram station is visible <br /> from a continuous main aisle, and in such a manner that the entire <br /> 25 back of any person viewing a panoram device is visible when <br /> observed from the continuous main aisle. The panoram station <br /> 26 shall at no time be obscured by any curtain, door or other <br /> enclosure. <br /> 27 2. Doors to areas on the premises which are available for use by <br /> 28 persons other than the licensee or employees of the licensee shall <br /> not be locked during business hours. <br /> 29 3. Illumination shall be maintained which is generally distributed in <br /> 30 all parts of the premises available for use by the public. Such <br /> illumination shall be not less than ten (10) foot candles at floor <br /> 31 level at all times when the premises are open or when any member <br /> of the public is permitted to enter and remain therein. <br /> 32 <br /> -6- <br />
