1 or by imprisonment not to exceed six months or by both such fine and imprisonment. <br /> 2 B. Reckless Operation. Any person who operates any vessel in willful or <br /> 3 wanton disregard for the safety of persons or property is guilty of reckless operation. <br /> 4 C. Exceeding Speed Limit Evidence of Reckless Operation. The unlawful <br /> 5 operation of a vessel in excess of the maximum lawful speeds provided in this ordinance <br /> 6 at the point of operation and under the circumstances described shall be prima facie <br /> 7 evidence of the operation of a vessel in a reckless manner by the operator thereof. <br /> 8 D. Operating Vessel in a Negligent Manner. It shall be unlawful for any <br /> 9 person to operate a vessel in a negligent manner. For the purpose of this section, tf' <br /> 10 "operate in a negligent manner" shall be construed to mean the operation of a vessel in <br /> 11 such a manner as to endanger or be likely to endanger any persons or property. <br /> 12 The offense of operating a vessel in a negligent manner shall be <br /> 13 considered to be a lesser offense than, but included in, the offense of operating a vessel <br /> 14 in a reckless manner, and any person charged with operating a vessel in a reckless <br /> 15 manner may be convicted of the lesser offense of operating a vessel in a negligent <br /> 16 manner. <br /> 17 E. Water Littering. It shall be unlawful for any person to dump, throw, or <br /> 18 otherwise deposit junk, trash, garbage, refuse, litter, or other waste and/or foreign <br /> 19 material, into Silver Lake; provided, that nothing herein shall prohibit the cleaning of <br /> 20 freshly caught fish and depositing the waste matter therefrom in lake areas a <br /> 21 reasonable distance from swimming and bathing beaches. <br /> 22 F. Citations Authorized. Whenever any person is arrested for any violatic.i <br /> 23 of this ordinance, the arresting officer may serve upon him a citation and notice to <br /> 24 appear in court. The arrested person, in order to secure release and when permitted by <br /> 25 the arresting officer, must give his written promise to appear in court as required by <br /> 26 the citation and notice by signing in the appropriate place the written citation and <br /> 27 notice served by the arresting officer. Upon the arrested person's failure or refusing to <br /> 28 sign such written promise and notice, he may be taken into custody by such arresting <br /> 29 officer and placed in confinement. <br /> 30 Section 11: ENFORCEMENT. <br /> 31 A.
