1 places adjacent to Silver Lake public notices which shall specify the current specified <br /> 2 restrictions applicable to the particular lake as set out in this ordinance. Such notices <br /> 3 shall be conspicuously posted on or adjacent to every wharf of every boat livery and or <br /> 4 or adjacent to every public launching ramp and/or wharf and at such other locations as <br /> 5 will reasonably inform the public of these restrictions. <br /> 6 B. Police Duties. It shall be the duty of the Everett Police Department to <br /> 7 enforce the provisions of this ordinance. When a violation of this ordinance is made in <br /> 8 the Everett police officer's presence, he may board any vessel and he may arrest any <br /> 9 violator. In all other cases, arrest for violation of this ordinance shall be made pursuant <br /> 10 to warrant issued by a judge of a court of competent jurisdiction. <br /> 11 Section 12: NO SPECIAL DUTY CREATED. It is expressly the purpose of <br /> 12 this code to provide for and promote the health, safety and welfare of the general <br /> 13 public, and not to create or otherwise establish or designate any particular class of <br /> 14 group of persons who will or should be especially protected or benefited by the terms of <br /> 15 this code. <br /> 16 It is the specific intent of this code that no provision nor term used in this <br /> 17 code is intended to impose any duty whatsoever upon the City or any of its officers or <br /> 18 employees, for whom the implementation or enforcement of this Code shall be <br /> 19 discretionary and not mandatory. <br /> 20 Nothing contained in this code is intended to be nor shall be construed to <br /> 21 create or form the basis for any liability on the part of the City, or its officers, <br /> 22 employees or agents, for any injury or damage resulting from the failure to comply with <br /> 23 the provisions of this code, or by reason or in consequence of any inspection, notice, <br /> 24 order, certificate, permission or approval authorized or issued or done in connection <br /> 25 with the implementation or enforcement of this code, or by reason of any action or <br /> 26 inaction on the part of the City related in any manner to the enforcement of this code <br /> 27 by its officers, employees or agents. <br /> 28 Section 13: SEVERABILITY. If any court shall find any provision of this <br /> 29 ordinance or its application to any person or circumstance to be unconstitutional or <br /> 30 otherwise invalid, such finding shall not affect the validity of all remaining portions of <br /> 31 / / / / / <br /> 32 / / / / / <br /> -12- <br />
