unreasonably endanger the life, limb, property, or other rights of any person. In no <br /> 1 event shall the speed as set forth in subsection A above be exceeded except for <br /> 2 race-type boat operation in the manner authorized by this ordinance. <br /> 3 C. Speed Regulations--Special Circumstances. Unless conditions of the <br /> 4 water, traffic and congestion, weather, size and configuration of' the lake, freedom <br /> 5 from obstruction to view, or other circumstances demand greater distance and/or <br /> 6 slower speed, it shall be unlawful for any person to-operate any vessel: <br /> 7 1. At a speed greater than idling speed or eight miles per hour <br /> 8 (8 mph), whichever is the lesser, within one hundred (100) feet of any swimmer, skin <br /> 9 and/or scuba diver's flag or artifically illuminated marker buoy, other vessel and <br /> 10 floating objects. <br /> 11 2. In the water area of the lake designated as a "swimming only" area, <br /> 12 or as a "vessel prohibited" area, except this provision does not apply to vessels actually <br /> 13 used in the rescue of persons in distress. <br /> 14 3. At a speed greater than idling speed or eight miles per hour <br /> 15 (8 mph), whichever is the lesser, within one hundred (100) feet of any shoreline, safety <br /> 16 buoy, safety buoy line, float, or wharf. <br /> 17 D. Fuel Handling. The handling of fuel or refueling of boats shall. be <br /> 18 prohibited within one hundred feet (100') of the shoreline of Silver Lake. <br /> 19 Section 3: WATERSKIING PROHIBITED. Due to the potential interference <br /> 20 with other water users, or danger of impact and wake damage presented to other water <br /> 21 users and health hazards, the operation of vessels for towing water skiers and <br /> 22 waterskiing on Silver Lake is prohibited. <br /> 23 Section 4: SUPPLEMENTAL RESTRICTIONS. The Everett Parks and <br /> 24 Recreation Board may, supplementary to the general restrictions imposed by this <br /> 25 ordinance, enact comprehensive restrictions on Silver Lake, which restrictions may <br /> 26 establish "swimming only" and "swimming prohibited" area, "diving only" or "diving <br /> 27 prohibited" and other water use restrictions or the type of hours for a given use for the <br /> 28 purpose of providing for the safety of water users and freedom from undue interference <br /> 29 from conflicting uses. <br /> 30 Section 5: WATER USE REGULATION EQUIPMENT. <br /> 31 A. Buoy Locations and Design. The Everett Parks and Recreation <br /> 32 Director, in accordance with regulations established by the Everett Park Board, is <br /> hereby authorized and directed to designate locations in the water areas of Silver Lake <br /> -3- <br />
