/, <br /> 19th AVENUE SOUTHEAST STUDY AREA REZONE <br /> CONCOMITANT AGREEMENT TO REZONE ORDINANCE NO. 7/19--05" <br /> II <br /> THIS AGREEMENT is made and entered this o?? day o J <br /> 1985, by Richard Fletcher hereinafter referred to as Owner, and the City of <br /> Everett, a municipal corporation under the laws of the State of Washington, <br /> hereinafter referred to as the City; <br /> WITNESSETH: <br /> WHEREAS, RICHARD FLETCHER is owner of a tract of real property ] <br /> approximately .87 of an acre in size located north of 102nd St. S.E. between <br /> Interstate 5 and 19th Ave. S.E. (SR 527) , Everett, Snohomish County, <br /> Washington, the legal description of which is attached hereto as Exhibit A and ; <br /> I incorporated herein by this reference; and <br /> WHEREAS, such zoning and development is adjacent to the I-5 corridor <br /> and 19th Avenue S.E. and will provide for a major commercial center abutting <br /> these two north/south entry corridors to the City of Everett; and <br /> WHEREAS, the public health, safety, and welfare would be best served by <br /> anticipating the impact of such development and imposing certain mutually <br /> agreed upon standards, conditions and requirements which shall be documented <br /> herein and hereafter considered to be an integral part of the zoning <br /> restrictions applicable to the property; and <br /> WHEREAS, the Owners have agreed to develop the aforementioned property <br /> ' per the 19th Avenue S.E. Comprehensive Plan (The Plan), which is incorporated <br /> herein by reference in consideration of the City considering designating the <br /> property C-2 and the Owners further agree as part of said consideration that <br /> should the City zone the property C-2, to lay out, develop, and maintain the <br /> property as hereinafter set forth; <br /> NOW THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> CONCOMITANT AGREEMENT - 1 <br />
