• <br /> ORDINANCE NO. %J 22 74/6-- <br /> AN <br /> 46AN ORDINANCE amending Ordinance No. 172-71 and adding new sections <br /> regulating the operation of card lock fuel dispensing devices. <br /> WHEREAS, certain businesses in the City of Everett wish to operate what is <br /> known as card lock or key-type fuel dispensing mechanisms; and <br /> WHEREAS, the 1982 Uniform Fire Code authorizes the dispensing of Class I or <br /> Class II liquids without supervision by a qualified attendant under certain conditions; <br /> and <br /> WHEREAS, the 1982 Uniform Fire Code authorizes the dispensing of liquified <br /> petroleum gas only by a qualified attendant; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: A new section is added to Ordinance No. 172-71 which reads as <br /> follows: <br /> "Section 8: Card Lock Fuel Dispensing. <br /> Card lock or key-type fuel dispensing mechanisms for Class I and Class II <br /> liquids, and liquified petroleum gases shall be authorized so long as they <br /> are dispensed by a qualified attendant for service stations which are not <br /> open to the public and for which the mechanism is used only by <br /> commercial, industrial, governmental or manufacturing establishments for <br /> fueling vehicles used in connection with their businesses, provided that <br /> the owner of such station is accountable for the safe operation of the <br /> station and the training of the users thereof. Such stations may include <br /> card or key operated dispensers. Each service station operating a card or <br /> key operated dispenser shall provide the City with a letter signed by a <br /> duly authorized representative of the service station indicating the name <br /> of the commercial, industrial, governmental or manufacturing establish- <br /> ment authorized to use the card or key operated dispenser, and the name <br /> of the individual employed by the establishment trained to operate the <br /> dispensing mechanism. Such letter shall also indicate the date or dates on <br /> which the individual was trained in the use of the dispenser." <br /> Section 2: A new section is added to Ordinance No. 172-71 which reads as <br /> follows: <br /> "Section 9: Fire Protection Mechanisms. <br /> All vehicles for which fuel is dispensed from a card lock or key-type <br /> operated dispenser shall keep in the vehicle at least one fire protection <br /> mechanism and/or fire extinguisher in good operating condition accept- <br /> able to the City Fire Marshal. Such fire protection shall include at least <br /> one (1) fire extinguisher with a 2A-20 BC rating or better. <br /> All service stations utilizing card lock or key-type fuel dispensing <br /> mechanisms shall have at least one (1) fire extinguisher with a 2A-20BC <br /> rating or better available at each island where card lock or key-type <br /> dispensing mechanisms are operated." <br />
